s 36 Rights of owner of patent

(1) Subject and without prejudice to the other provisions of this Part, the owner of a patent shall have the following exclusive rights in relation to the patent: (a) to exploit the patented invention; (b) to assign or transmit the patent; (c) to conclude licence contracts; and (d) to deal with the patent as the subject of a security interest. (2) No person shall do any of the acts referred to in subsection (1) without the consent of the owner of the patent. (3) For the purposes of this Part, β€œexploitation” of a patented invention means any of the following acts in relation to a patent: (a) when the patent has been granted in respect of a product: (i) making, importing, offering for sale, selling or using the product; (ii) stocking such product for the purpose of offering for sale, selling or using; (b) when the patent has been granted in respect of a process: (i) using the process; (ii) doing any of the acts referred to in paragraph (a), in respect of a product obtained directly by means of the process. (4) For the purposes of this section, if the patent has been granted in respect of a process for obtaining a product, the same product produced by a person other than the owner of the patent or his licensee shall, unless the contrary is proved, be taken in any proceedings to have been obtained by that process. (5) In proving to the contrary in any proceedings referred to in subsection (4), the person other than the owner of the patent or his licensee shall not be required to disclose any manufacturing or commercial secret if the court is satisfied that it is unreasonable or unnecessary to do so, or prejudicial to the manufacturing or commercial secret of that person.

Hak pemunya paten

(1) Tertakluk pada dan tanpa menjejaskan peruntukan lain Bahagian ini, pemunya sesuatu paten hendaklah mempunyai hak eksklusif yang berikut berhubung dengan paten itu: (a) untuk mengeksploit reka cipta yang telah dipatenkan; (b) untuk menyerahhak atau memindahkan paten itu; (c) untuk membuat kontrak lesen; dan (d) untuk menguruskan paten sebagai subjek kepentingan bercagar. (2) Tiada seorang pun boleh melakukan apa-apa tindakan yang disebutkan dalam subseksyen (1) tanpa keizinan pemunya paten itu. (3) Bagi maksud Bahagian ini, β€œeksploitasi” sesuatu reka cipta yang dipaten ertinya mana-mana tindakan yang berikut berhubung dengan sesuatu paten: (a) jika paten itu telah diberi berkenaan dengan sesuatu keluaran: (i) membuat, mengimport, menawarkan untuk jualan, menjual atau menggunakan keluaran itu; (ii) membekalkan keluaran itu bagi maksud menawarkan untuk jualan, menjual atau menggunakan; (b) jika paten itu telah diberi berkenaan dengan sesuatu proses: (i) menggunakan proses itu; (ii) melakukan mana-mana tindakan yang disebutkan dalam perenggan (a), berkenaan dengan sesuatu keluaran yang didapati secara langsung mengikut cara proses itu. (4) Bagi maksud seksyen ini, jika paten telah diberikan mengenai suatu proses bagi mendapatkan suatu keluaran, keluaran yang sama yang dikeluarkan oleh seseorang yang bukan pemunya paten atau pemegang lesennya hendaklah, melainkan jika dibuktikan sebaliknya, dianggap dalam apa-apa prosiding sebagai telah didapati melalui proses itu. (5) Dalam membuktikan sebaliknya dalam mana-mana prosiding yang disebut dalam subseksyen (4), orang selain pemunya paten atau pemegang lesennya tidak boleh dikehendaki untuk mendedahkan apaapa rahsia pengilangan atau komersial jika mahkamah berpuas hati bahawa ia tidak munasabah atau tiada keperluan untuk berbuat demikian, atau memudaratkan rahsia pengilangan atau komersial orang itu.
