s 38 Rights derived from prior manufacture or use
(1) Where a person at the priority date of the patent application—
(a) was in good faith in Malaysia making the product or using the process which is the subject of the invention claimed in the application;
(b) had in good faith in Malaysia made serious preparations towards the making of the product or using the process referred to in paragraph (a),
he shall have the right, despite the grant of the patent, to exploit the patented invention:
Provided that the product in question is made, or the process in question is used, by the said person in Malaysia:
Provided further that he can prove, if the invention was disclosed under the circumstances referred to in paragraph 14(3) (a), (b) or (c) that his knowledge of the invention was not a result of such disclosure.
(2) The right referred to in subsection (1) shall not be assigned or transmitted except as part of the business of the person concerned.

Hak yang diperoleh daripada pengilangan atau penggunaan terdahulu
(1) Jika seseorang, pada tarikh prioriti permohonan paten—
(a) telah, dengan suci hati di Malaysia, membuat keluaran atau menggunakan proses yang menjadi subjek bagi reka cipta yang dituntut dalam permohonan itu;
(b) telah, dengan suci hati di Malaysia, membuat beberapa persediaan serius untuk membuat keluaran atau menggunakan proses yang disebutkan dalam perenggan (a),
dia adalah berhak, walaupun paten itu diberi, untuk mengeksploit reka cipta yang dipaten itu:
Dengan syarat bahawa keluaran yang berkenaan itu dibuat, atau proses yang berkenaan itu digunakan, oleh orang yang tersebut di Malaysia:
Dengan syarat selanjutnya bahawa dia boleh membuktikan, jika reka cipta itu dizahirkan di bawah hal keadaan yang disebutkan dalam perenggan 14(3) (a), (b) atau (c) bahawa pengetahuannya tentang reka cipta itu bukanlah hasil daripada penzahiran itu.
(2) Hak yang disebutkan dalam subseksyen (1) tidak boleh diserah hak atau dipindahkan kecuali sebagai sebahagian daripada perniagaan orang yang berkenaan.
