(1) In the absence of any provision to the contrary in the licence contract, the licensor may grant a further licence to a third person in respect of the same patent or himself do any or all of the acts referred to in paragraph 36(1)(a), and subsection 36(3).
(2) Where the licence contract provides that the licence is exclusive and unless it is expressly provided otherwise in such contract, the licensor shall not grant a further licence to a third person in respect of the same patent or himself do any of the acts referred to in paragraph 36(1)(a) and subsection 36(3).

Hak pemberi lesen
(1) Dengan tiadanya apa-apa peruntukan yang berlawanan dalam kontrak lesen, pemberi lesen boleh memberi suatu lesen selanjutnya kepada pihak ketiga berkenaan dengan paten yang sama atau dia sendiri melakukan sesuatu atau semua tindakan yang disebutkan dalam perenggan 36(1)(a) dan juga subseksyen 36(3).
(2) Sekiranya kontrak lesen memperuntukkan bahawa lesen itu adalah eksklusif dan melainkan jika ianya diperuntukkan selainnya secara nyata dalam kontrak tersebut, pemberi lesen tidak boleh memberi lesen selanjutnya kepada pihak ketiga berkenaan dengan paten yang sama atau dia sendiri melakukan apa-apa tindakan yang disebutkan dalam perenggan 36(1)(a) dan juga subseksyen 36(3).
