s 49 Application for compulsory licences

(1) At any time after the expiration of three years from the grant of a patent, or four years from the filing date of the patent application, whichever is the later, any person may apply to the Registrar for a compulsory licence under any of the following circumstances: (a) where there is no production of the patented product or application of the patented process in Malaysia without any legitimate reason; (b) where there is no product produced in Malaysia under the patent for sale in any domestic market, or there are some but they do not meet public demand without any legitimate reason. (1A) Notwithstanding subsection (1), at any time after the grant of a patent, any person may make an application to the Registrar for a compulsory licence— (a) where the products produced in Malaysia under the patent for sale in the domestic market are sold at unreasonably high prices without any legitimate reason; or (b) for the purposes of production of a pharmaceutical product in Malaysia and exportation of such pharmaceutical product to an eligible importing country to deal with its public health problem. (2) Except for paragraph (1A)(b), a compulsory licence shall not be applied for unless the person making the application has made efforts to obtain authorization from the owner of the patent on reasonable commercial terms and conditions but such efforts have not been successful within a reasonable period of time. (3) The application for a compulsory licence shall be in compliance with such regulations as may be prescribed by the Minister.

Permohonan bagi lesen wajib

(1) Pada bila-bila masa selepas habis tempoh tiga tahun dari pemberian sesuatu paten, atau empat tahun dari tarikh pemfailan permohonan paten, mengikut mana-mana yang terkemudian, manamana orang boleh memohon kepada Pendaftar untuk mendapatkan suatu lesen wajib di bawah mana-mana hal keadaan yang berikut: (a) jika tidak ada pengeluaran keluaran yang dipaten itu atau penggunaan proses yang dipaten itu dalam Malaysia tanpa apa-apa sebab yang sah; (b) jika tidak ada keluaran dikeluarkan dalam Malaysia di bawah paten itu untuk jualan dalam mana-mana pasaran domestik, atau ada didapati beberapa tetapi tidak memenuhi permintaan orang ramai tanpa apa-apa sebab yang sah. (1A) Walau apa pun subseksyen (1), pada bila-bila masa selepas pemberian paten, mana-mana orang boleh membuat permohonan kepada Pendaftar untuk mendapatkan lesen wajib— (a) jika keluaran yang dikeluarkan dalam Malaysia di bawah paten itu untuk jualan dalam pasaran domestik dijual dengan harga tinggi yang tidak munasabah tanpa apa-apa sebab yang sah; atau (b) bagi maksud pengeluaran keluaran farmaseutikal dalam Malaysia dan pengeksportan keluaran farmaseutikal itu ke negara pengimport yang layak untuk menangani masalah kesihatan awamnya. (2) Kecuali bagi perenggan (1A)(b), sesuatu lesen wajib tidak boleh dipohon melainkan jika orang yang membuat permohonan itu sudah berusaha untuk mendapatkan kebenaran daripada pemunya paten atas terma dan syarat perdagangan yang munasabah tetapi usaha itu telah tidak berjaya dalam tempoh masa yang munasabah. (3) Permohonan bagi mendapatkan suatu lesen wajib hendaklah mematuhi apa-apa peraturan sebagaimana yang ditetapkan oleh Menteri.
