s 53 Limitation of compulsory licence
(1) A compulsory licence granted by the Registrar —
(a) shall not be assigned otherwise than in connection with the goodwill or business or that part of the goodwill or business in which the patented invention is used;
(b) shall be limited to the supply of the patented invention predominantly in Malaysia.
(1A) The limitation specified in paragraph (1)(b) shall not apply to the compulsory licence granted for the purposes of production and exportation of the pharmaceutical product under paragraph 49(1A)(b).
(2) The beneficiary of the compulsory licence shall not conclude licence contracts with third persons under the patent in respect of which the compulsory licence was granted.

Pembatasan lesen wajib
(1) Sesuatu lesen wajib yang diberikan oleh Pendaftar —
(a) tidak boleh diserahhakkan selain berkaitan dengan nama baik atau perniagaan atau bahagian nama baik atau perniagaan itu yang di dalamnya reka cipta yang dipaten itu digunakan;
(b) hendaklah terbatas kepada pembekalan reka cipta yang dipaten itu terutamanya dalam Malaysia.
(1A) Pembatasan yang dinyatakan dalam perenggan (1)(b) tidak terpakai bagi lesen wajib yang diberikan bagi maksud pengeluaran dan pengeksportan keluaran farmaseutikal di bawah perenggan 49(1A)(b).
(2) Benefisiari bagi lesen wajib itu tidak boleh membuat kontrak lesen dengan orang ketiga di bawah paten yang berkenaan dengannya lesen wajib itu telah diberikan.
