s 55 Surrender of patent
(1) The owner of the patent may surrender the patent by a written declaration submitted to the Registrar.
(2) The surrender may be limited to one or more claims of the patent.
(3) Where a licence contract in respect of a patent is recorded in the Register, the Registrar shall not, in the absence of any provision to the contrary in the licence contract, accept or record the said surrender except upon receipt of a signed declaration by which every licensee or
sub-licensee on record consents to the said surrender unless the requirement of his consent is expressly waived in the licence contract.
(3A) Where a compulsory licence has been granted in respect of a patent, the Registrar shall not accept or record the said surrender except upon receipt of a signed declaration by which the beneficiary of the compulsory licence consents to the said surrender.
(4) The Registrar shall record the surrender in the Register and cause it to be published in the Official Journal.
(5) The surrender shall take effect from the date the Registrar receives the declaration and such declaration shall not be withdrawn.

Penyerahan paten
(1) Pemunya paten boleh menyerahkan paten melalui suatu akuan bertulis yang dikemukakan kepada Pendaftar.
(2) Penyerahan boleh dihadkan kepada satu atau lebih tuntutan mengenai paten.
(3) Apabila suatu kontrak lesen berkenaan dengan paten direkodkan dalam Daftar, Pendaftar tidaklah boleh, dengan tiadanya apa-apa peruntukan yang berlawanan dalam kontrak lesen, menyetuju terima atau merekodkan penyerahan tersebut kecuali setelah penerimaan akuan yang ditandatangani yang menurutnya tiap-tiap pemegang lesen atau pemegang lesen kecil atas rekod bersetuju dengan penyerahan tersebut melainkan jika kehendak mengenai persetujuannya dilepaskan dengan nyata dalam kontrak lesen itu.
(3A) Jika suatu lesen wajib telah diberikan berkenaan dengan suatu paten, Pendaftar tidak boleh menerima atau merekodkan penyerahan tersebut kecuali setelah diterima akuan yang ditandatangani yang menurutnya benefisiari lesen wajib itu bersetuju dengan penyerahan tersebut.
(4) Pendaftar hendaklah merekodkan penyerahan itu dalam Daftar dan mengarahkannya supaya disiarkan dalam Jurnal Rasmi.
(5) Penyerahan itu hendaklah berkuat kuasa dari tarikh Pendaftar menerima akuan itu dan akuan itu tidak boleh ditarik balik.
