s 19 Petroleum storage and petroleum handling licences

(1) Subject to the provisions of this Act, no person shall store or handle any petroleum unless he is the holder of a valid petroleum storage licence or a valid petroleum handling licence, as the case may be, granted under this Act authorizing the storage or handling of petroleum and providing that such petroleum is to be stored or handled in accordance with such conditions, if any, as may be attached to the licence. (1A) Subsection (1) shall not apply in respect of any person acting lawfully under the supervision or instruction of a person in possession of a valid petroleum handling licence issued under this Act. (2) For the purposes of this Act, the Minister hereby authorizes the following to grant or refuse petroleum storage or petroleum handling licences under this section— (a) in respect of any area under a local authority, or authority in the case of Sabah, after consultation with the State Authority, such local authority or authority; and (b) in respect of any area other than areas referred to under paragraph (a) such person as the Minister shall by order authorize. (3) For the purpose of the application of subsection (2) to the Federal Territories of Kuala Lumpur and Labuan, “State Authority” means the Minister charged with the responsibility for local government. (4) The occupier of any premises in which petroleum is stored or handled in contravention of this section or any condition of a petroleum storage or petroleum handling licence granted under this section shall be guilty of an offence and shall be liable on conviction to a fine not exceeding ten thousand ringgit and to a further fine of two thousand ringgit for each day or part of a day on which the contravention occurs or continues and any petroleum, and any tools, apparatus or containers in which it is contained may be seized and shall be liable to forfeiture. (5) A petroleum storage or petroleum handling licence granted under this section shall be in force for such time as specified in the licence and shall contain such conditions as may be necessary, in particular, conditions as to the mode of storage, the nature and situation of the premises in which, and the nature of goods with which, petroleum is to be stored, the manner of handling petroleum, the facilities of testing petroleum from time to time and generally as to the safe-keeping of petroleum. (6) Where conditions to be observed by person employed are attached to any such petroleum storage or petroleum handling licence, the occupier of the premises to which the licence relates shall cause to be kept posted on the premises, in such form and in such position as to be easily read by the persons employed on the premises, a notice setting out those conditions, and— (a) if the occupier of any premises fail to comply with the foregoing requirements of this subsection, he shall be guilty of an offence and shall be liable on conviction to a fine not exceeding five thousand ringgit and to a further fine of one thousand ringgit for each day or part of a day during which the failure occurs or continues; (b) if any person pulls down, damages, or defaces any notice posted in accordance with the requirements of this subsection, he shall be liable to a fine not exceeding five thousand ringgit; and (c) if any person employed by the occupier contravenes any condition of which notice has been given in accordance with the requirements of this subsection, he shall be guilty of an offence and shall on conviction be liable to a fine not exceeding five thousand ringgit. *NOTE—Section. 18A is not yet in force–see Act A843.

Lesen penstoran petroleum dan pengendalian petroleum

(1) Tertakluk pada peruntukan Akta ini, tiada seorang pun boleh menstor atau mengendalikan apa-apa petroleum melainkan jika dia ialah pemegang lesen penstoran petroleum yang sah atau lesen pengendalian petroleum yang sah, mengikut mana-mana yang berkenaan, yang diberi di bawah Akta ini yang membenarkan penstoran atau pengendalian petroleum dan memperuntukkan bahawa petroleum itu hendaklah distor atau dikendalikan mengikut apa-apa syarat, jika ada, sebagaimana yang terdapat pada lesen itu. (1A) Subseksyen (1) tidaklah terpakai berkenaan dengan manamana orang yang bertindak dengan sah di bawah pengawasan atau arahan seseorang yang memiliki lesen pengendalian petroleum yang sah yang dikeluarkan di bawah Akta ini. (2) Bagi maksud Akta ini, Menteri dengan ini memberi kuasa kepada orang yang berikut untuk memberi atau menolak lesen penstoran petroleum atau pengendalian petroleum di bawah seksyen ini− (a) berkenaan dengan mana-mana kawasan di bawah suatu pihak berkuasa tempatan, atau pihak berkuasa mengenai Sabah, selepas berunding dengan Pihak Berkuasa Negeri, pihak berkuasa tempatan atau pihak berkuasa itu; dan (b) berkenaan dengan mana-mana kawasan selain kawasan yang tersebut di bawah perenggan (a), orang yang diberi kuasa oleh Menteri dengan perintah. (3) Bagi maksud pemakaian subseksyen (2) kepada Wilayah Persekutuan Kuala Lumpur dan Labuan, “Pihak Berkuasa Negeri” ertinya Menteri yang bertanggungjawab bagi kerajaan tempatan. (4) Penghuni mana-mana premis di mana petroleum ada distor atau dikendalikan yang melanggari seksyen ini atau apa-apa syarat lesen penstoran petroleum atau pengendalian petroleum yang diberikan di bawah seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit dan denda tambahan sebanyak dua ribu ringgit bagi tiap-tiap satu hari atau sebahagian daripada satu hari yang pelanggaran itu berlaku atau berterusan dan apa-apa petroleum, dan apa-apa alatan, perkakas atau bekas dalam mana ia terkandung boleh disita dan boleh dilucut hak. (5) Suatu lesen penstoran petroleum atau pengendalian petroleum yang diberi di bawah seksyen ini hendaklah berkuat kuasa bagi masa-masa sebagaimana dinyatakan dalam lesen itu dan hendaklah mengandungi apa-apa syarat sebagaimana perlu, khususnya, syarat mengenai cara penstoran, jenis dan keadaan premis dalam mana, dan jenis barang-barang yang dengannya, petroleum hendak distor, cara mengendalikan petroleum, kemudahan menguji petroleum dari semasa ke semasa dan amnya mengenai jagaan selamat petroleum. (6) Jika syarat yang hendak dipatuhi oleh seseorang yang diambil kerja dikenakan kepada mana-mana lesen penstoran petroleum atau pengendalian petroleum itu, penghuni premis yang dimaksudkan oleh lesen itu hendaklah menyebabkan supaya sentiasa ditampalkan di premis itu, dalam suatu bentuk dan di suatu tempat supaya mudah dibaca oleh orang yang diambil kerja di premis itu, suatu notis menyatakan syarat itu, dan— (a) jika penghuni mana-mana premis itu tidak mematuhi kehendak tersebut di atas dalam subseksyen ini, dia melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ribu ringgit dan denda tambahan sebanyak satu ribu ringgit bagi tiap-tiap satu hari atau sebahagian daripada satu hari yang kegagalan itu berlaku atau berterusan; (b) jika mana-mana orang menurunkan, merosakkan, atau mencacatkan apa-apa notis yang ditampal mengikut kehendak subseksyen ini, dia boleh didenda tidak melebihi lima ribu ringgit; dan (c) jika mana-mana orang yang diambil kerja oleh penghuni itu melanggar apa-apa syarat yang baginya notis telah diberi mengikut kehendak subseksyen ini, dia melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ribu ringgit.
