s 42 Revocation of licence, etc.

(1) The person or authority granting any licence, permit, approval or extension under this Act may, if such person or authority is satisfied that— (a) the apparatus or premises so licensed, permitted or approved has become unfit for the purpose for which it was licensed, permitted or approved; (b) the person to whom such licence, permit, approval or extension was granted has committed a breach of any of the conditions of such licence, permit, approval or extension, or (c) the continuance of the licence, permit, approval or extension is against public safety, call upon the holder of the licence, permit, approval or extension to show cause why his licence, permit, approval or extension should not be revoked. (2) A person called upon to show cause under subsection (1)— (a) shall be supplied by the person or authority as the case may be, with the particulars in writing forming the basis for the call to show cause; and (b) may, if he so desires, be present at the hearing or be represented thereat by another person authorized by him in writing. (3) If after the hearing, the person or authority as the case may be, is of opinion that the person called upon to show cause has failed to do so, such person or authority may notwithstanding any criminal proceedings that may be brought against the person called upon to show cause, revoke his licence, permit, approval or extension. (4) Subsection (1) shall not prejudice the power of the person or authority referred to therein, to suspend the licence, permit, approval or extension pending the hearing to show cause, if such person or authority considers such an action to be expedient and necessary in the circumstances of the case.

Pembatalan lesen, dsb.

(1) Orang atau pihak berkuasa yang memberi mana-mana lesen, permit, kelulusan atau tempoh lanjutan di bawah Akta ini boleh, jika orang atau pihak berkuasa itu berpuas hati bahawa— (a) radas atau premis yang diberi lesen, permit atau kelulusan sedemikian telah menjadi tidak layak yang bagi maksudnya ia telah diberi lesen, permit atau kelulusan; (b) orang yang kepadanya lesen, permit, kelulusan atau tempoh lanjutan itu diberikan telah melakukan pelanggaran terhadap mana-mana syarat lesen, permit, kelulusan atau tempoh lanjutan itu; atau (c) penerusan lesen, permit, kelulusan atau tempoh lanjutan itu adalah bertentangan dengan keselamatan awam, meminta pemegang lesen, permit, kelulusan atau tempoh lanjutan supaya menunjukkan sebab mengapa lesen, permit, kelulusan atau tempoh lanjutannya tidak patut dibatalkan. (2) Seseorang yang diminta menunjukkan sebab di bawah subseksyen (1)— (a) hendaklah diberikan butir-butir secara bertulis yang menjadi asas dia diminta menunjukkan sebab oleh orang atau pihak berkuasa, mengikut mana yang berkenaan; dan (b) boleh, jika dia kehendaki sedemikian, hadir di pendengaran itu atau diwakili di pendengaran itu oleh seorang lain yang diberi kuasa olehnya secara bertulis. (3) Jika selepas pendengaran, orang atau pihak berkuasa itu, mengikut mana yang berkenaan, berpendapat bahawa orang yang diminta menunjukkan sebab telah tidak berbuat demikian, maka orang atau pihak berkuasa itu boleh, walaupun terdapat apa-apa prosiding jenayah yang mungkin dibawa terhadap orang yang diminta menunjukkan sebab itu, membatalkan lesen, permit, kelulusan atau tempoh lanjutannya. (4) Subseksyen (1) tidaklah menyentuh kuasa orang atau pihak berkuasa yang disebut dalamnya untuk menggantung lesen, permit, kelulusan atau tempoh lanjutan sementara menunggu keputusan pendengaran menunjukkan sebab itu, jika orang atau pihak berkuasa itu fikirkan sesuatu tindakan seperti itu sebagai suai manfaat dan perlu mengikut hal keadaan kes itu.
