Atomic Energy Licensing Act 1984 s 49
If the installation operator proves that the nuclear damage resulted wholly or partly either from the gross negligence of the person suffering the damage or from an act or omission of such person with intent to cause damage, the court may relieve the installation operator from paying compensation in respect of the damage suffered by such person.
Kecuaian melampau atau tindakan sengaja pihak menuntut
Jika pengendali pepasangan membuktikan bahawa kerosakan nuklear tersebut telah disebabkan kesemuanya atau sebahagiannya sama ada oleh kecuaian melampau orang yang mengalami kerosakan itu atau oleh suatu perbuatan atau ketinggalan orang itu dengan niat untuk menyebabkan kerosakan, mahkamah boleh melepaskan pengendali pepasangan itu daripada membayar pampasan berkenaan dengan kerosakan yang dialami oleh orang itu.
