Atomic Energy Licensing Act 1984 s 65

s 65 When claims exceed maximum limit

When it appears that the nuclear damage from a nuclear incident may exceed the limit of liability established under section 59, and upon application by the Government of Malaysia where it intends to act pursuant to section 61, the court having jurisdiction in the matter shall issue such orders as may be necessary to assure the equitable distribution of compensation, including orders apportioning the payments to be made to claimants and orders permitting partial payment to be made before final determination of the total claims.

Bila tuntutan melebihi had maksimum

Apabila didapati bahawa kerosakan nuklear yang disebabkan oleh suatu insiden nuklear mungkin melebihi had liabiliti yang ditetapkan di bawah seksyen 59, dan apabila permohonan dibuat oleh Kerajaan Malaysia dimana ia bercadang untuk bertindak menurut seksyen 61, mahkamah yang mempunyai bidang kuasa dalam perkara itu hendaklah mengeluarkan apa-apa perintah, yang perlu untuk memastikan pembahagian yang saksama akan pampasan, termasuk perintah mengumpukkan pembayaran yang akan dibuat kepada pihak menuntut dan perintah yang membenarkan pembayaran separa dibuat sebelum jumlah tuntutan diputuskan dengan muktamad.
