s 25 Power to revoke or suspend licence

(1) The Board may revoke or suspend any licence granted under this Act— (a) on the ground that any of the provisions of this Act or any other written law or that any of the conditions of the licence has not been complied with; (b) on the ground that the grant of the licence was induced by a false representation of fact by or on behalf of the holder; or (c) where it is satisfied that the motor vehicle has been or is intended to be used for an unlawful purpose or that the original purpose for which the licence was issued no longer exists: Provided that the Board shall not revoke or suspend the licence on the ground of the breach of any of the conditions unless it is satisfied, after giving the holder of the licence an opportunity of making any representation in writing he may wish to make, that owing to the frequency of the breach, or to the breach having been committed wilfully or to the danger to the public involved in the breach, the licence should be revoked or suspended. (2) For the purposes of subsection (1), a breach of any of the conditions specified in paragraph 20(1)(a) or (b) shall be deemed to be a breach which constitutes danger to the public. (3) Where a licence has been revoked or suspended, it shall have no effect from the date of revocation or during the period of suspension, as the case may be.

Kuasa membatalkan atau menggantung lesen

(1) Lembaga boleh membatalkan atau menggantung apa-apa lesen yang diberikan di bawah Akta ini— (a) atas alasan bahawa mana-mana peruntukan Akta ini atau mana-mana undang-undang bertulis lain atau mana-mana syarat lesen telah tidak dipatuhi; (b) atas alasan bahawa lesen itu telah didorongi oleh kenyataan palsu mengenai fakta oleh pemegang lesen itu atau bagi pihaknya; atau (c) jika Lembaga berpuas hati bahawa kenderaan motor itu telah digunakan atau dicadang hendak digunakan bagi maksud yang menyalahi undang-undang atau maksud asal yang baginya lesen itu dikeluarkan tidak lagi wujud: Dengan syarat bahawa Lembaga tidaklah boleh membatalkan atau menggantung lesen itu atas alasan pelanggaran mana-mana syarat melainkan ia berpuas hati, selepas memberi peluang kepada pemegang lesen untuk membuat apa-apa representasi bertulis yang mahu dibuatnya, bahawa oleh kerana kerapnya berlaku pelanggaran atau oleh kerana pelanggaran itu dilakukan secara sengaja atau oleh kerana bahaya kepada awam akibat daripada pelanggaran itu, lesen itu patut dibatalkan atau digantung. (2) Bagi maksud subseksyen (1), pelanggaran mana-mana syarat yang dinyatakan dalam perenggan 20(1)(a) atau (b) hendaklah disifatkan sebagai pelanggaran yang merupakan bahaya kepada awam. (3) Jika sesuatu lesen telah dibatalkan atau digantung, ia tidak akan berkuat kuasa dari tarikh pembatalan itu atau semasa tempoh penggantungan tersebut, mengikut mana-mana yang berkenaan.
