s 22 Unclaimed property

(1) Subject to subsection (2), it shall be the duty of every police officer to take charge of unclaimed movable property which is handed by any person to, or found by, him; and he shall deliver such property to the officer in charge of the nearest police station, who shall cause to be posted in some conspicuous place at the police station a notice specifying such property and calling upon any person who may have any claim thereto within two months from the date of such notice to appear and establish his claim. (2) If the property aforesaid is of a perishable nature the officer in charge may cause it to be sold forthwith and shall forward to the Officer in Charge of the Police District the proceeds of such sale; and such proceeds shall, after the deduction of any expenses reasonably incurred, be paid to the person who within the period specified in subsection (1) establishes his claim thereto. (3) Any property aforesaid which is not claimed within the period specified in subsection (1) may be sold or otherwise disposed of or destroyed in such manner as the Commanding Officer may direct; and the proceeds of any sale of such property shall, after the deduction of any expenses reasonably incurred in such sale, be apportioned in the following manner— (a) such proportion as the Commanding Officer may direct may be paid to the finder of the property; (b) the first fifty ringgit of the balance, if any, shall be paid into the Police Fund established under Part XIII and the remainder shall be paid into the general revenues of Malaysia. (4) No police officer or extra police officer shall purchase any property sold under this section; and any police officer or extra police officer who contravenes this subsection shall be guilty of an offence against discipline.

Harta yang tidak dituntut

(1) Tertakluk kepada subseksyen (2), adalah menjadi tugas tiap-tiap pegawai polis untuk menjaga harta alih yang tidak dituntut yang diberikan oleh mana-mana orang kepadanya, atau yang dijumpai olehnya; dan dia hendaklah menyerahkan harta itu kepada pegawai yang menjaga balai polis yang berhampiran sekali, yang mana hendaklah menyebabkan ditampal di suatu tempat yang mudah dilihat di balai polis itu suatu notis menyatakan harta itu dan meminta sesiapa yang mungkin ada apa-apa tuntutan ke atasnya dalam tempoh dua bulan dari tarikh notis itu supaya hadir dan membuktikan tuntutannya. (2) Jika harta yang tersebut dahulu adalah daripada jenis mudah musnah, pegawai yang menjaganya boleh menyebabkan harta itu dijual dengan segera dan hendaklah menghantar kepada Pegawai Penjaga Daerah Polis hasil jualan itu; dan hasil jualan itu hendaklah, selepas ditolak apa-apa perbelanjaan yang semunasabahnya ditanggung, dibayar kepada orang yang dalam tempoh yang dinyatakan dalam subseksyen (1) membuktikan tuntutannya ke atasnya. (3) Mana-mana harta yang tersebut dahulu, yang tidak dituntut dalam tempoh yang dinyatakan dalam subseksyen (1) boleh dijual atau, secara lain dilupuskan atau dimusnahkan mengikut cara yang diarahkan oleh Pegawai Memerintah; dan keuntungan daripada apaapa jualan harta itu hendaklah, selepas ditolak apa-apa perbelanjaan yang semunasabahnya ditanggung dalam jualan itu, dibahagikan secara berikut― (a) apa-apa bahagian yang diarahkan oleh Pegawai Memerintah boleh dibayar kepada orang yang menjumpai harta itu; (b) lima puluh ringgit yang pertama daripada bakinya, jika ada, hendaklah dibayar kepada Kumpulan Wang Polis yang ditubuhkan di bawah Bahagian XIII dan selebihnya hendaklah dibayar kepada hasil am Persekutuan. (4) Tiada seorang pun pegawai polis atau pegawai polis tambahan boleh membeli mana-mana harta yang dijual di bawah seksyen ini; dan mana-mana pegawai polis atau pegawai polis tambahan yang melanggar subseksyen ini adalah melakukan suatu kesalahan terhadap disiplin.
