(1) No railway shall be opened without the Minister’s approval.
(2) The Minister shall only give his approval to the opening of a railway after he has received a written report from an engineer appointed by the Director General that—
(a) he has made a careful inspection of the railway;
(b) the weight of rails, strength of bridges, general structural character of the works, and the size of and maximum gross load upon the axles of any rolling-stock are such as have been prescribed by any regulations made under this Act; and
(c) in his opinion the opening of the railway will not cause any danger to the passengers or any damage to the goods to be carried thereon.
(3) This section shall apply mutatis mutandis—
(a) to any addition forming part of or directly connected to a railway constructed after the inspection which preceded the first opening of the railway; and
(b) to any reconstruction materially affecting the structural character of any railway.

Menteri hendaklah meluluskan pembukaan keretapi
(1) Tiada keretapi boleh dibuka tanpa kelulusan Menteri.
(2) Menteri hendaklah memberikan kelulusannya bagi pembukaan suatu keretapi hanya setelah dia menerima suatu laporan bertulis daripada jurutera yang dilantik oleh Ketua Pengarah bahawa—
(a) dia telah membuat pemeriksaan cermat akan keretapi itu;
(b) berat rel, kekuatan jambatan, sifat struktur am kerja, dan saiz serta muatan kasar maksimum di atas gandar manamana stokereta adalah seperti yang telah ditetapkan oleh mana-mana peraturan yang dibuat di bawah Akta ini; dan
(c) pada pendapatnya pembukaan keretapi itu tidak akan menyebabkan apa-apa bahaya kepada penumpang atau apa-apa kerosakan kepada barang yang dibawa di atasnya.
(3) Seksyen ini hendaklah terpakai mutatis mutandis—
(a) bagi apa-apa kerja tambahan yang menjadi sebahagian daripada atau berkaitan secara langsung dengan keretapi yang telah dibina selepas pemeriksaan yang mendahului pembukaan pertama keretapi itu; dan
(b) bagi apa-apa pembinaan semula yang menyentuh secara material sifat struktur mana-mana keretapi.
