s 37 Review by High Court
(1) Where a fugitive criminal is ordered by the Sessions Court to be discharged under subsection 19(4), the Public Prosecutor may, at the request of the country seeking his return, within ten days of the making of the order by the Sessions Court, apply to the High Court for a review of the order of discharge on any question of law, and on such application the High Court may so review the order.
(2) Where the Public Prosecutor desires to make such an application, he shall, at the time of the making of the order of discharge by the Sessions Court, give to the Court notice of his intention to apply to the High Court for a review of the order, and such notice shall operate as a stay of the order of discharge by the Sessions Court—
(a) until the expiration of the period of ten days, beginning with the day on which the order of discharge was made; or
(b) if an application for a review of the order of discharge is made, until the determination of the application by the High Court.
(3) Where the Public Prosecutor gives notice of his intention to apply for a review of the order of the Sessions Court, the Court may grant, to the fugitive criminal in respect of whom the order of discharge was made, bail pending the determination by the High Court of the application.
(4) Upon application for a review of the order of discharge, the Sessions Court Judge shall transmit to the High Court the exhibits tendered before him, the evidence admitted in Court, the reasons for his decision and his finding on any question of law which arose during the inquiry.
(5) The High Court to which an application is made for a review of an order of discharge may order the release on bail of the fugitive criminal on such terms and conditions as the Court thinks fit pending determination of the application for review.
(6) The High Court may confirm, vary or quash the order or make a new order in substitution for the order so quashed, and any such order of the High Court shall be final and conclusive.

Kajian semula Mahkamah Tinggi
(1) Jika seseorang penjenayah buruan diperintahkan oleh Mahkamah Sesyen supaya dilepaskan di bawah subseksyen 19(4), Pendakwa Raya boleh, atas permintaan negara yang cuba mendapatkan pemulangannya, dalam masa sepuluh hari dari perintah itu dibuat oleh Mahkamah Sesyen, memohon kepada Mahkamah Tinggi bagi mendapatkan kajian semula perintah pelepasan itu mengenai apa-apa persoalan undang-undang, dan atas permohonan itu Mahkamah Tinggi boleh mengkaji semula perintah itu.
(2) Jika Pendakwa Raya berhasrat untuk membuat permohonan sedemikian, dia hendaklah, pada masa perintah pelepasan itu dibuat oleh Mahkamah Sesyen, memberi Mahkamah itu notis tentang niatnya hendak memohon kepada Mahkamah Tinggi bagi mendapatkan kajian semula perintah itu, dan notis itu hendaklah berkuat kuasa sebagai penggantungan perintah pelepasan oleh Mahkamah Sesyen―
(a) sehingga habis tempoh sepuluh hari, bermula dari hari perintah pelepasan itu dibuat; atau
(b) jika permohonan bagi kajian semula perintah pelepasan itu dibuat, sehingga permohonan itu diputuskan oleh Mahkamah Tinggi.
(3) Jika Pendakwa Raya memberikan notis tentang niatnya untuk memohon kajian semula perintah Mahkamah Sesyen itu, Mahkamah itu boleh membenarkan, kepada penjenayah buruan yang berkenaan dengannya perintah pelepasan itu dibuat, jaminan sementara menanti pemutusan permohonan itu oleh Mahkamah Tinggi.
(4) Apabila permohonan bagi mendapatkan kajian semula perintah pelepasan itu dibuat, Hakim Mahkamah Sesyen hendaklah menghantar kepada Mahkamah Tinggi barang kes yang dikemukakan di hadapannya, keterangan yang diterima di Mahkamah, sebab bagi keputusannya dan pendapatnya mengenai apa-apa persoalan undangundang yang berbangkit semasa siasatan.
(5) Mahkamah Tinggi yang kepadanya sesuatu permohonan dibuat bagi mendapatkan kajian semula terhadap sesuatu perintah pelepasan boleh memerintahkan supaya penjenayah buruan itu dilepaskan dengan jaminan atas terma dan syarat yang difikirkan patut oleh Mahkamah sementara menunggu penentuan permohonan bagi mendapatkan kajian semula itu.
(6) Mahkamah Tinggi boleh mengesahkan, mengubah atau membatalkan perintah itu atau membuat suatu perintah baru bagi menggantikan perintah yang telah dibatalkan itu, dan apa-apa perintah Mahkamah Tinggi yang sedemikian adalah muktamad dan konklusif.
