Extradition Act 1992 s 48

s 48 Simultaneous requisitions

(1) If requisitions for the return of a fugitive criminal are received from more than one country, the Minister may, having regard to the circumstances of the case, return the fugitive criminal to such country as he thinks fit. (2) The Minister, in determining to which country the fugitive criminal should be returned, shall consider all the circumstances of the case and in particular— (a) the relative seriousness of the offence; (b) the relative dates on which the requests were made; and (c) the citizenship or other national status of the fugitive criminal and his ordinary residence.

Rekuisisi serentak

(1) Jika rekuisi bagi pemulangan seseorang penjenayah buruan diterima daripada lebih daripada satu negara, Menteri boleh, setelah mengambil kira hal keadaan kes itu, memulangkan penjenayah buruan itu kepada negara yang difikirkannya patut. (2) Menteri, dalam menentukan kepada negara yang manakah penjenayah buruan itu sepatutnya dipulangkan, hendaklah menimbangkan segala hal keadaan kes itu dan khususnya― (a) keseriusan, secara perbandingan, kesalahan itu; (b) tarikh, secara perbandingan, permintaan itu dibuat;dan (c) kewarganegaraan atau taraf kerakyatan lain penjenayah buruan itu dan tempat bermastautin biasa.
