Extradition Act 1992 s 49

s 49 Discretion in respect of return of certain fugitive criminals

(1) The Minister may, in his discretion, refuse the surrender or the return of a fugitive criminal if— (a) the fugitive criminal is a citizen of Malaysia; or (b) the extradition offence is one in respect of which the courts in Malaysia have jurisdiction. (2) Where extradition is refused under subsection (1), the Minister shall, if courts in Malaysia have jurisdiction over the extradition offence, submit the case to the Public Prosecutor with a view to having the fugitive criminal prosecuted under the laws of Malaysia.

Budi bicara berkenaan dengan pemulangan penjenayah buruan tertentu

(1) Menteri boleh, mengikut budi bicaranya, enggan menyerahkan atau memulangkan seseorang penjenayah buruan jika― (a) penjenayah buruan itu warganegara Malaysia; atau (b) kesalahan ekstradisi itu ialah kesalahan yang berkenaan dengannya yang mahkamah di Malaysia mempunyai bidang kuasa. (2) Jika ekstradisi ditolak di bawah subseksyen (1), Menteri hendaklah, jika mahkamah di Malaysia mempunyai bidang kuasa terhadap kesalahan ekstradisi itu, mengemukakan kes itu kepada Pendakwa Raya dengan tujuan supaya penjenayah buruan itu didakwa di bawah undang-undang Malaysia.
