s 50 Taking of evidence for purpose of criminal matters pending in a country

(1) The Minister may, by order under his hand and seal, require a Magistrate to take evidence for the purpose of any extradition matter pending in any Court or Tribunal in any country. (2) Upon the receipt of such order, the Magistrate shall take the evidence of every witness appearing before him for the purpose referred to in subsection (1) in like manner as if such witness appeared on a preliminary enquiry into the case of a person accused of an offence triable by the High Court and shall certify at the foot of the depositions so taken that such evidence was taken before him and shall transmit the same to the Minister. (3) The evidence referred to in subsection (1) may be taken in the presence or absence of the accused person, if any, and the fact of such presence or absence shall be stated in such depositions. (4) This section shall not apply in the case of any criminal matter of a political character.

Pengambilan keterangan bagi maksud perkara jenayah yang belum diputuskan di sesuatu Negara

(1) Menteri boleh, melalui perintah di bawah tandatangan dan meterainya, menghendaki seseorang Majistret mengambil keterangan bagi maksud apa-apa perkara jenayah yang belum diputuskan di mana-mana Mahkamah atau Tribunal di mana-mana negara. (2) Apabila perintah itu diterima, Majistret hendaklah mengambil keterangan tiap-tiap saksi yang hadir di hadapannya bagi maksud yang disebutkan dalam subseksyen (1) mengikut cara yang sama seolah-olah saksi itu hadir bagi suatu siasatan permulaan dalam kes seseorang yang dituduh atas suatu kesalahan yang boleh dibicarakan oleh Mahkamah Tinggi dan hendaklah mengesahkan pada kaki deposisi yang diambil sedemikian bahawa keterangan itu telah diambil di hadapannya dan hendaklah menghantarnya kepada Menteri. (3) Keterangan yang disebutkan dalam subseksyen (1) boleh diambil semasa orang yang dituduh, jika ada, hadir atau tidak hadir dan hakikat kehadiran atau ketidakhadiran itu hendaklah dinyatakan dalam deposisi itu. (4) Seksyen ini tidak terpakai dalam hal apa-apa perkara jenayah yang bersifat politik.
