s 102 Registration of deed

(1) The management company shall submit the deed referred to in paragraph 97(1)(b) to the Commission for registration and such deed shall not have effect unless so registered. (2) On an application for registration of a deed, the Commission may— (a) register the deed; (b) register the deed with such revisions or subject to such terms and conditions as it deems fit; or (c) refuse to register the deed. (3) An application under subsection (2) shall be made in accordance with such procedure or other requirement as may be specified by the Commission. (4) The Commission shall refuse to register a deed under paragraph (2)(c) if— (a) it appears to the Commission that the deed does not comply with the requirements of this Act or any other requirement as may be specified by the Commission; (b) the making available of, offer for subscription or purchase of, or invitation to subscribe for or purchase, a unit to which the deed relates has not been approved by the Commission under section 32; or (c) the trustee referred to in paragraph 97(1)(a) has not been appointed for the purposes of the deed. (5) Subject to subsection (4), the Commission shall register a deed together with an application for its registration.
