s 124 Disapplication of Division 5 of Part IV

(1) Division 5 of Part IV shall not apply to an issue, offer or invitation made to a person or a class of persons, or made in respect of a unit trust scheme or prescribed investment scheme or a class of unit trust schemes or prescribed investment schemes as the Minister may, on the recommendation of the Commission, prescribe by order published in the Gazette. (2) A prescription made under subsection (1) may specify the provisions of Division 5 of Part IV to which an issue, offer or invitation shall not apply. (3) The Minister, on the recommendation of the Commission, may from time to time by order published in the Gazette, vary, delete, add to, substitute for, or otherwise amend the prescription made under subsection (1) and upon such publication, the prescription as varied, deleted, added to, substituted for or otherwise amended, shall come into full force and effect and shall be deemed to be an integral part of this Act as from the date of such publication or such later date as may be specified in the order.
