s 13 Power to fix tariffs

(1) A licensee may, in relation to the service of supplying gas, levy such tariffs as may be approved in writing by the Minister from time to time having regard to any condition in the licence which relates to the supply of gas in different areas and circumstances. (2) A proposal for tariff under subsection (1) may include— (a) a standing charge in addition to the charge for the actual gas supplied; (b) a charge in respect of the availability of a supply of gas and such charge may vary according to the extent of supply; and (c) a rent or other charge in respect of any gas meter or installation provided by the licensee. (3) A tariff approved pursuant to subsection (1)— (a) shall be so framed by the licensee as to indicate the methods by which and the principles on which the tariffs are to be made as well as the prices which are to be charged; and (b) shall be published by the licensee in such manner that will secure adequate publicity for it. (4) In fixing tariffs pursuant to subsection (1) and in making agreements for the supply of gas under subsection 18(1), a licensee shall not show undue preference or discrimination as among consumers or persons similarly situated having regard to the place and time of supply, the quantity of gas supplied and the purpose for which the supply is taken. (5) In this section— “standing charge” means a fixed charge approved by the Commission for the provision of the supply of gas and includes the cost to maintain the system.

Kuasa untuk menetapkan tarif

(1) Seseorang pemegang lesen boleh, berhubungan dengan perkhidmatan pembekalan gas, mengenakan apa-apa tarif yang diluluskan secara bertulis oleh Menteri dari semasa ke semasa dengan mengambil kira apa-apa syarat dalam lesen itu yang berhubungan dengan pembekalan gas di kawasan dan dalam hal keadaan yang berlainan. (2) Sesuatu cadangan tarif di bawah subseksyen (1) boleh termasuk— (a) suatu caj tetap sebagai tambahan kepada caj bagi gas yang sebenarnya dibekalkan; (b) suatu caj berkenaan dengan adanya bekalan gas dan caj sedemikian boleh berubah mengikut takat bekalan; dan (c) suatu sewa atau caj lain berkenaan dengan apa-apa meter gas atau pepasangan yang diadakan oleh pemegang lesen. (3) Sesuatu tarif yang diluluskan menurut subseksyen (1)— (a) hendaklah dirangkakan sedemikian rupa oleh pemegang lesen supaya menunjukkan cara-cara bagaimana dan prinsip yang berdasarkannya tarif akan dibuat serta juga harga yang akan dikenakan; dan (b) hendaklah disiarkan oleh pemegang lesen mengikut apa-apa cara yang akan memastikan publisiti yang mencukupi bagi tarif itu. (4) Dalam menetapkan tarif menurut subseksyen (1) dan dalam membuat perjanjian bagi pembekalan gas di bawah subseksyen 18(1), seseorang pemegang lesen tidak boleh menunjukkan keutamaan atau diskriminasi tidak wajar di kalangan pengguna atau orang yang dalam keadaan yang sama memandangkan tempat dan masa pembekalan, kuantiti gas yang dibekalkan dan maksud yang baginya bekalan diambil. (5) Dalam seksyen ini— “caj tetap” ertinya caj tetap yang diluluskan oleh Suruhanjaya bagi pengadaan bekalan gas dan termasuk kos untuk menyenggara sistem.
