Where an offence under this Act has been committed by a body corporate, a person who at the time of the commission of the offence is a director, manager, secretary or other similar officer of the body corporate or a person who was purporting to act in such capacity shall, as well as the body corporate, be deemed to be guilty of that offence unless he proves that the offence was committed without his knowledge or that he took reasonable precautions to prevent its commission.

Kesalahan oleh pertubuhan perbadanan
Jika sesuatu kesalahan di bawah Akta ini telah dilakukan oleh sesuatu pertubuhan perbadanan, maka seseorang yang, pada masa kesalahan itu dilakukan, ialah pengarah, pengurus, setiausaha atau pegawai serupa itu bagi pertubuhan perbadanan itu atau seseorang yang berupa sebagai bertindak atas kapasiti itu hendaklah, di samping pertubuhan perbadanan itu, disifatkan telah melakukan kesalahan itu, melainkan jika dia membuktikan bahawa kesalahan itu telah dilakukan tanpa pengetahuannya atau bahawa dia telah mengambil langkah yang munasabah untuk mencegahnya daripada berlaku.
