s 15 Standard specifications

(1) The Minister may, by notification in the Gazette, declare any specification that has been adopted with or without modification, to be a standard specification or a provisional standard specification for the purposes of this Act, and may amend or withdraw any standard specification or provisional standard specification. (2) Where a specification has been declared to be a provisional standard specification, the expression “Provisional” or “P” shall be included in the title or number of the standard specification. (3) No specification shall be declared to be a standard specification, and no standard specification shall be amended or withdrawn, unless the Minister is satisfied that the persons who may be affected by the declaration, amendment or withdrawal have had an opportunity to consider it and to comment thereon to the Minister or to the Council or to an authorized committee of the Council: Provided that this subsection shall not apply to a provisional standard specification. (4) The declaration, amendment or withdrawal of a standard specification shall be made in the manner prescribed by regulations or, if no such regulations have been made, in such manner as may be determined by the Minister. (5) The Minister shall cause the fact of the declaration, amendment or withdrawal, but not the text of the specification declared, amended or withdrawn, and the date on which it is to take effect, to be notified in the Gazette. (6) In the absence of proof to the contrary— (a) a notification in the Gazette under subsection (5) shall be sufficient evidence of the matters stated therein; and (b) the fact that a specification has been declared to be a standard specification or that a standard specification has been amended or withdrawn shall be sufficient evidence that the requirements of this section have been complied with.

Penentuan standard

(1) Menteri boleh, melalui pemberitahuan dalam Warta, mengisytiharkan mana-mana penentuan yang telah diterima pakai dengan atau tanpa ubah suaian, sebagai suatu penentuan standard atau suatu penentuan standard sementara bagi maksud Akta ini, dan boleh meminda atau menarik balik mana-mana penentuan standard atau penentuan standard sementara. (2) Jika sesuatu penentuan telah diisytiharkan sebagai suatu penentuan standard sementara, ungkapan “Sementara” atau “S” hendaklah dimasukkan ke dalam tajuk atau nombor penentuan standard itu. (3) Tiada penentuan boleh diisytiharkan sebagai penentuan standard, dan tiada penentuan standard boleh dipinda atau ditarik balik, melainkan jika Menteri berpuas hati bahawa orang yang mungkin terjejas oleh perisytiharan, pindaan atau penarikbalikan itu telah mendapat peluang untuk menimbangkannya dan memberikan ulasan mengenainya kepada Menteri atau kepada Majlis atau kepada sesuatu jawatankuasa Majlis yang diberi kuasa: Dengan syarat bahawa subseksyen ini tidak terpakai bagi penentuan standard sementara. (4) Perisytiharan, pindaan atau penarikbalikan sesuatu penentuan standard hendaklah dibuat mengikut cara yang ditetapkan oleh peraturanperaturan atau, jika tiada peraturan sedemikian dibuat, mengikut apa-apa cara yang ditentukan oleh Menteri. (5) Menteri hendaklah menyebabkan hakikat perisytiharan, pindaan atau penarikbalikan itu, tetapi bukan teks penentuan yang diisytiharkan, dipinda atau ditarik balik itu, dan tarikh ia berkuat kuasa, diberitahu dalam Warta. (6) Tanpa bukti yang sebaliknya— (a) suatu pemberitahuan dalam Warta di bawah subseksyen (5) hendaklah menjadi keterangan yang mencukupi mengenai perkara yang dinyatakan dalamnya; dan (b) hakikat bahawa sesuatu penentuan telah diisytiharkan sebagai suatu penentuan standard atau bahawa sesuatu penentuan standard telah dipinda atau ditarik balik hendaklah menjadi keterangan yang mencukupi bahawa kehendak seksyen ini telah dipatuhi.
