Private Higher Educational Institutions Act 1996 s 38
s 38 Prior approval of Registrar General on course of study and affiliation, etc.
(1) The prior approval of the Registrar General shall be obtained before a private higher educational institution—
(a) may conduct a course of study or training programme;
(b) may conduct a course of study or training programme jointly or in affiliation, association or collaboration with any University, University College, higher educational institution, whether public or private, or professional body, within or outside Malaysia.
(1A) No course of study or training programme shall be conducted by the private higher educational institution unless the private higher educational institution has been registered under section 24.
(2) A private higher educational institution which contravenes the provision of this section shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding two hundred thousand
ringgit or to imprisonment for a term not exceeding two years or to both.

Kelulusan terdahulu Ketua Pendaftar mengenai kursus pengajian dan gabungan, dsb.
(1) Kelulusan Ketua Pendaftar hendaklah diperoleh terlebih dahulu sebelum sesuatu institusi pendidikan tinggi swasta—
(a) boleh mengendalikan sesuatu kursus pengajian atau program latihan;
(b) boleh mengendalikan sesuatu kursus pengajian atau program latihan secara bersesama atau bergabung, bersekutu atau bekerjasama dengan mana-mana Universiti, Kolej Universiti, institusi pendidikan tinggi, sama ada awam atau swasta, atau badan profesional, di dalam atau di luar Malaysia.
(2) Institusi pendidikan tinggi swasta yang melanggar peruntukan seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua ratus ribu ringgit atau dipenjarakan selama tempoh yang tidak melebihi dua tahun atau kedua-duanya.
