s 6 Application for approval

(1) The prior approval of the Minister shall be obtained before a private higher educational institution may be established or maintained. (2) An application for an approval under this section shall be made to the Registrar General— (a) on the prescribed form and in the prescribed manner; (b) accompanied by the prescribed fee; (c) by submitting together with the application— (i) a comprehensive plan for the establishment and maintenance of the proposed private higher educational institution which shall include the proposed courses of study; (ii) a copy of the draft of the constitution of the proposed private higher educational institution; and (iii) the following documents: (aa) a copy of its constituent document, duly verified by a statutory declaration made by an authorized officer of the applicant; and (bb) a copy of the latest audited balance sheet, profit and loss account and the reports, if any, of the auditors and the directors of the applicants, if applicable; and (d) such other information, particulars or documents as may be requested by the Registrar General for the purpose of determining the application and the suitability of the applicant. (3) At any time after receiving the application and before it is determined by the Minister, the Registrar General may by written notice require the applicant to provide additional information, particulars or documents. (4) The matters specified under subsection (2) and the requirement under subsection (3) may differ as between different applicants, classes, categories or descriptions of applicants. (5) An application under this section may be withdrawn at any time before it is granted or refused. (6) Where additional information, particulars or documents required under paragraph (2)(d) or subsection (3) is or are not provided by the applicant within the specified time or an extension thereof, the application— (a) shall be deemed to have been withdrawn; and (b) shall not be further proceeded with, without prejudice to a fresh application being made by the applicant.

Permohonan untuk kelulusan

(1) Kelulusan Menteri hendaklah diperoleh terlebih dahulu sebelum sesuatu institusi pendidikan tinggi swasta boleh ditubuhkan atau disenggarakan. (2) Permohonan bagi mendapatkan kelulusan di bawah seksyen ini hendaklah dibuat kepada Ketua Pendaftar— (a) dalam borang yang ditetapkan dan mengikut cara yang ditetapkan; (b) disertai fi yang ditetapkan; (c) dengan mengemukakan bersekali dengan permohonan itu— (i) pelan menyeluruh bagi penubuhan dan penyenggaraan institusi pendidikan tinggi swasta yang dicadangkan yang hendaklah termasuk kursus pengajian yang dicadangkan; (ii) salinan draf perlembagaan institusi pendidikan tinggi swasta yang dicadangkan; dan (iii) dokumen-dokumen yang berikut: (aa) suatu salinan dokumen konstituennya, yang ditentusahkan dengan sewajarnya melalui akuan berkanun yang dibuat oleh pegawai yang diberi kuasa bagi pemohon; dan (bb) suatu salinan kunci kira-kira teraudit, akaun untung dan rugi dan laporan yang terbaru jika ada, oleh juruaudit dan pengarah pemohon, jika berkenaan; dan (d) apa-apa maklumat, butir-butir atau dokumen lain sebagaimana yang diminta oleh Ketua Pendaftar bagi maksud menentukan permohonan dan kesesuaian pemohon. (3) Pada bila-bila masa selepas menerima permohonan dan sebelum ia ditentukan oleh Menteri, Ketua Pendaftar boleh melalui notis secara bertulis menghendaki pemohon memberikan maklumat, butir-butir atau dokumen tambahan. (4) Perkara yang dinyatakan dalam subseksyen (2) dan yang dikehendaki di bawah subseksyen (3) boleh berbeza antara pemohon, kelas, kategori atau perihalan pemohon yang berlainan. (5) Permohonan di bawah seksyen ini boleh ditarik balik pada bila-bila masa sebelum ia diluluskan atau ditolak. (6) Jika maklumat, butir-butir atau dokumen tambahan yang dikehendaki di bawah perenggan (2)(d) atau subseksyen (3) tidak diberikan oleh pemohon dalam masa yang dinyatakan atau lanjutan masa yang diberikan baginya, maka permohonan itu— (a) hendaklah disifatkan telah ditarik balik; dan (b) tidak boleh diteruskan, tanpa menjejaskan hak pemohon membuat permohonan baru.
