s 60 Notice of intention to close down

(1) A private higher educational institution which is about to cease its operations except for the reasons specified in paragraphs 59(a) and (b) and subparagraph 59(d)(ii), shall give a notice of its intention to do so at least for a period of one calendar year before its closing down. (2) The notice under subsection (1) shall beβ€” (a) given to the Registrar General by the chief executive of the private higher educational institution; (b) served by A.R. registered mail on the students of the private higher educational institution; and (c) published in the newspapers, at least one in the national language and one in any other language. (3) Where the closing down of the private higher educational institution is by reason of paragraphs 59(a) and (b) and subparagraph 59(d)(ii), the private higher educational institution shall within twenty-one days after being notified of the decision of the Minister to revoke its approval, the decision of the Registrar General to cancel its registration or order of the court for the company to wind up, as the case may beβ€” (a) serve a notice of its closing down to its students by A.R. registered mail; and (b) publish a notice of its closing down in the newspapers, at least one in the national language and one in any other language. (4) Where the closing down of the private higher educational institution is by reason of paragraph 59(e), the chief executive shall request for instructions from the Registrar General with respect to the notification of the closing down. (5) A private higher educational institution which contravenes this section shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Notis tentang niat untuk menutup

(1) Sesuatu institusi pendidikan tinggi swasta yang sedang hendak menghentikan kegiatan perniagaannya kecuali atas sebab yang dinyatakan dalam perenggan 59(a) dan (b) dan subperenggan 59(d)(ii), hendaklah memberikan notis tentang niatnya untuk berbuat sedemikian sekurang-kurangnya bagi tempoh selama satu tahun kalendar sebelum penutupannya. (2) Notis di bawah subseksyen (1) hendaklahβ€” (a) diberikan kepada Ketua Pendaftar oleh ketua eksekutif institusi pendidikan tinggi swasta itu; (b) disampaikan melalui surat berdaftar Akuan Terima kepada pelajar institusi pendidikan tinggi swasta itu; dan (c) disiarkan dalam akhbar, sekurang-kurangnya satu dalam bahasa kebangsaan dan satu lagi dalam apa-apa bahasa lain. (3) Jika penutupan institusi pendidikan tinggi swasta adalah atas sebab dalam perenggan 59(a) dan (b) dan subperenggan 59(d)(ii), maka institusi pendidikan tinggi swasta itu hendaklah dalam masa dua puluh satu hari selepas diberitahu tentang keputusan Menteri untuk membatalkan kelulusannya, keputusan Ketua pendaftar untuk mengkenselkan pendaftarannya atau perintah mahkamah supaya syarikat digulung, mengikut mana-mana yang berkenaanβ€” (a) menyampaikan notis penutupannya kepada pelajarnya melalui surat berdaftar Akuan Terima; dan (b) menyiarkan notis penutupannya dalam akhbar, sekurangkurangnya satu dalam bahasa kebangsaan dan satu lagi dalam apa-apa bahasa lain. (4) Jika penutupan institusi pendidikan tinggi swasta itu ialah kerana alasan dalam perenggan 59(e), ketua eksekutif hendaklah meminta arahan daripada Ketua Pendaftar berkenaan dengan pemberitahuan penutupannya. (5) Institusi pendidikan tinggi swasta yang melanggar seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.
