s 74 Interpretation of advertisement
For the purposes of sections 72 and 73, “advertisement” means any notification or information of the establishment of a private higher educational institution—
(a) published in any newspaper, journal or magazine or any other form;
(b) displayed on any hoarding, boarding, roof, wall, paling, fence, frame, signboard, plate, cloth, bar, pillar, post, wirecasting or other erection, structure or contrivance;
(c) conveyed by means of film within the meaning of the Films Censorship Act 2002 [Act 620] or by means of
broadcast sound receivers or television receivers within the meaning of the ***Communications and Multimedia (Technical Standards) Regulations 2000 [P.U.(A) 124/2000]; or
(d) conveyed by electronic or other means, oral or written and whether of the same kind or not as set out in paragraphs (a) to (c).
NOTE—This Act has replaced the Trade Descriptions Act 1972 [Act 87]–see section 70 of Act 730. NOTE—This Act has replaced the Films (Censorship) Act 1952 [Act 35]–see section 53 of Act 620. ***NOTE—The Telecommunications (Television Receivers) Regulations 1964 [L.N. 69/1964] has since been repealed by the Radiocommunications Regulations 1995 [P. U. (A) 224/1995] which was later repealed by the Communications And Multimedia (Technical Standards) Regulations 2000 [P.U. (A) 124/2000].

Bagi maksud seksyen 72 dan 73, “iklan” ertinya apa-apa pemberitahuan atau maklumat mengenai penubuhan institusi pendidikan tinggi swasta—
(a) yang disiarkan dalam mana-mana akhbar, jurnal atau majalah atau apa-apa bentuk lain;
(b) yang dipamerkan pada mana-mana papan iklan, papan, bumbung, dinding, paling, pagar, rangka, papan tanda, plat, kain rentang, palang, batang tiang, tonggak, tuangan dawai atau binaan, struktur atau rekaan lain;
(c) yang disampaikan melalui filem dalam pengertian Akta Filem (Penapisan) 1952 [Akta 35] atau melalui alat terima radio atau alat terima televisyen dalam pengertian Peraturan-Peraturan Telekom (Alat Terima Televisyen) 1964 [L.N. 69/1964]; atau
(d) yang disampaikan melalui cara elektronik atau cara lain, secara lisan atau tulisan dan sama ada daripada bentuk yang sama atau tidak sebagaimana yang dinyatakan dalam perenggan (a) hingga (c).
