s 92 Minister’s power to exempt

(1) The Minister may, if he considers it desirable and in the interest of a private higher educational institution or in the interest of the students or the public, by order published in the Gazette, exempt the private higher educational institution from any provision of this Act. (2) The exemption granted under subsection (1) shall be subject to such conditions as the Minister may specify in the order. (3) The power of exemption under subsection (1) shall not include the provisions as to the approval for the establishment of a private higher educational institution and the registration thereof, and the provisions of sections 38 and 39. (4) The Minister may, at any time, use his discretion to revoke an exemption under this section or alter or add to conditions attached to the exemption.

Kuasa Menteri untuk mengecualikan

(1) Menteri boleh, jika difikirkannya wajar dan demi kepentingan sesuatu institusi pendidikan tinggi swasta atau demi kepentingan pelajar atau orang awam, melalui perintah yang disiarkan dalam Warta, mengecualikan institusi pendidikan tinggi swasta itu daripada mana-mana peruntukan Akta ini. (2) Pengecualian yang diberikan di bawah subseksyen (1) adalah tertakluk kepada apa-apa syarat yang dinyatakan oleh Menteri dalam perintah itu. (3) Kuasa mengecualikan di bawah subseksyen (1) tidak termasuk peruntukan tentang kelulusan bagi penubuhan institusi pendidikan tinggi swasta dan pendaftarannya, dan peruntukan seksyen 38 dan 39. (4) Menteri boleh, pada bila-bila masa, menggunakan budi bicaranya membatalkan pengecualian di bawah seksyen ini atau mengubah atau menambahkan kepada syarat pengecualian itu.
