East Coast Economic Region Development Council Act 2008 s 25

s 25 Principal coordinating agency

(1) The Council shall, in coordinating the performance of the activities carried out by any Government entity in the East Coast Economic Region— (a) act as the principal coordinating agent or authorized agent on behalf of the relevant Government entity to receive, process and expedite the requisite approvals and administrative actions in relation to applications for approvals in respect of which the Council has entered into an agreement or arrangement under section 26; and (b) render administrative services and assistance to the State Governments of Kelantan, Terengganu, Pahang and Johor in connection with matters relating to land within the East Coast Economic Region. (2) The Council may, in carrying out the role mentioned in paragraph (1)(a)— (a) impose on the applicant such fees, costs, contributions or any other charges as may be prescribed in respect of services rendered by the Council; and (b) on behalf of the relevant Government entity, collect from the applicant such fees, costs, contributions or any other charges as may be lawfully required by such Government entity in connection with the application. (3) For the purposes of this section, “approvals” means any approval of any Government entity, whether under any written law or not, and may include approval for or in relation to licence, permit, pass, registration, tax, excise and incentives, required or in connection with trade, investment and development in the East Coast Economic Region.

Agensi penyelaras utama

(1) Majlis hendaklah, dalam menyelaraskan pelaksanaan aktiviti yang dijalankan oleh mana-mana entiti Kerajaan di dalam Wilayah Ekonomi Pantai Timur— (a) bertindak sebagai ejen penyelaras utama atau ejen yang diberi kuasa bagi pihak entiti Kerajaan yang berkaitan untuk menerima, memproses dan menyegerakan kelulusan dan tindakan pentadbiran yang perlu berhubung dengan permohonan untuk mendapatkan kelulusan yang berkenaan dengannya Majlis telah membuat suatu perjanjian atau perkiraan di bawah seksyen 26; dan (b) memberi khidmat pengurusan dan bantuan kepada Kerajaan- Kerajaan Negeri Kelantan, Terengganu, Pahang dan Johor berkaitan dengan perkara­- perkara berhubung dengan tanah di dalam Wilayah Ekonomi Pantai Timur. (2) Majlis boleh, dalam menjalankan peranan yang disebut dalam perenggan (l)(a)— (a) mengenakan ke atas pemohon apa-apa fi, kos, sumbangan atau apa-apa caj lain sebagaimana yang ditetapkan berkenaan dengan perkhidmatan yang diberikan oleh Majlis; dan (b) bagi pihak entiti Kerajaan yang berkaitan, memungut daripada pemohon apa-apa fi, kos, sumbangan atau apaapa caj lain sebagaimana yang dikehendaki secara sah di sisi undang-undang oleh entiti Kerajaan itu berkaitan dengan permohonan itu. (3) Bagi maksud seksyen ini, “kelulusan” ertinya apa-apa kelulusan oleh mana-mana entiti Kerajaan, sama ada di bawah mana-mana undang-undang bertulis atau tidak, dan termasuk kelulusan bagi atau berkaitan dengan lesen, permit, pas, pendaftaran, cukai, eksais dan insentif, yang dikehendaki atau berkaitan dengan perdagangan, pelaburan dan pembangunan di dalam Wilayah Ekonomi Pantai Timur.
