s 40 Failure to comply with order
(1) Any person who fails to comply with an order of the Board made under section 33 or a decision of the Minister made under section 48 commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit and to imprisonment for a term not exceeding one year or to both.
(2) In addition to the penalty provided under subsection (1), the Board shall on the conviction of a registered geologist or registered practitioner under subsection (1) immediately revoke the registration of the registered geologist or registered practitioner concerned.

Kegagalan untuk mematuhi perintah
(1) Mana-mana orang yang tidak mematuhi perintah Lembaga yang dibuat di bawah seksyen 33 atau keputusan Menteri yang dibuat di bawah seksyen 48 melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit dan dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.
(2) Sebagai tambahan kepada penalti yang diperuntukkan di bawah subseksyen (1), Lembaga boleh apabila seseorang ahli geologi berdaftar atau pengamal berdaftar disabitkan di bawah subseksyen (1) membatalkan dengan serta-merta pendaftaran ahli geologi berdaftar atau pengamal berdaftar yang berkenaan.
