Deoxyribonucleic Acid (DNA) Identification Act 2009 s 17
s 17 Removal of DNA profile and information from suspected persons index
Where an intimate sample or a non-intimate sample has been taken in accordance with this Act from a person reasonably suspected of having committed an offence and—
(a) investigations reveal that he was not involved in the commission of any offence;
(b) the charge against him in respect of any offence is withdrawn;
(c) he is discharged by a court of an offence with which he has been charged, at trial or on appeal;
(d) he is acquitted of an offence with which he has been charged, at trial or on appeal; or
(e) he is not charged in any court for any offence within a period of one year from the date of taking of such sample from him,
the Head of DNA Databank shall, within six months of so being notified by the Officer in Charge of a Police District of the fact referred to in paragraph (a), (b), (c), (d), or (e), remove the DNA profile and any information in relation thereto of such person from the DNA Databank.

Penghapusan profil dan maklumat DNA daripada indeks orang yang disyaki
Jika suatu sampel intim atau sampel bukan intim telah diambil mengikut Akta ini daripada seseorang yang semunasabahnya disyaki telah melakukan suatu kesalahan dan—
(a) penyiasatan mendedahkan bahawa dia tidak terlibat dalam perlakuan apa-apa kesalahan;
(b) pertuduhan terhadapnya berkenaan dengan apa-apa kesalahan telah ditarik balik;
(c) dia dilepaskan oleh mahkamah daripada suatu kesalahan yang dia telah dipertuduhkan, semasa perbicaraan atau atas rayuan;
(d) dia dibebaskan daripada suatu kesalahan yang dia telah dipertuduhkan, semasa perbicaraan atau atas rayuan; atau
(e) dia tidak dipertuduhkan di mana-mana mahkamah atas apa-apa kesalahan dalam tempoh satu tahun dari tarikh pengambilan sampel daripadanya,
Ketua Bank Data DNA hendaklah, dalam tempoh enam bulan selepas diberitahu oleh Ketua Polis Daerah fakta yang dirujuk dalam perenggan (a), (b), (c), (d) atau (e), menghapuskan profil DNA dan apa-apa maklumat berhubung dengannya mengenai orang itu daripada Bank Data DNA.
