s 167 Revocation of consent, licence or registration

The Authority may revoke any consent, licence or registration made under this Act— (a) at the request of the licensed entity; (b) where— (i) the licensed entity has ceased to carry on business in or from within Labuan; (ii) the licensed entity has contravened any provision of this Act or any terms, conditions, restrictions or limitations attached to the licence or registration as the case may be; (iii) the Authority has, either in connection with the application for the licence or registration, or at any time after the grant of the licence or registration, been provided with false or misleading information, document or declaration by or on behalf of the licensed entity; (iv) the licensed entity has been convicted of an offence under this Act or of a criminal offence in any recognised country or jurisdiction; (v) the licensed entity has knowingly and wilfully supplied false, misleading or inaccurate information or failed to disclose information required under this Act; (vi) the licensed entity is carrying on business in a manner that the Authority reasonably believes to be detrimental to the interests of, in the case of licensed entities under Part III, investors of mutual funds, or to the public interest; (vii) the licensed entity is declared bankrupt or has been wound-up or otherwise dissolved; (viii) a resolution for the licensed entity’s voluntary winding-up has been passed; (ix) in relation to a bank licensee or an insurance licensee, where any guarantee or undertaking referred to in sections 88 and 89 or sections 103 and 104 has not been honoured; or (x) the Authority in its discretion deems fit for any other reason.

Pembatalan persetujuan, lesen atau pendaftaran

(1) Lembaga boleh membatalkan apa-apa persetujuan, lesen atau pendaftaran di bawah Akta ini— (a) atas permintaan entiti berlesen; (b) jika— (i) entiti berlesen itu berhenti menjalankan perniagaan dalam atau dari dalam Labuan; (ii) entiti berlesen itu telah melanggar mana-mana peruntukan Akta ini atau mana-mana terma, syarat, sekatan atau batasan yang berkaitan dengan lesen atau pendaftaran itu, mengikut mana-mana yang berkenaan; (iii) Lembaga telah, sama ada berkaitan dengan permohonan bagi lesen atau pendaftaran, atau pada bila-bila masa selepas pemberian lesen atau, pendaftaran itu, diberi maklumat, dokumen atau akuan yang palsu atau mengelirukan oleh atau bagi pihak entiti berlesen; (iv) entiti berlesen itu telah disabitkan dengan suatu kesalahan di bawah Akta ini atau suatu kesalahan jenayah dalam mana-mana negara atau bidang kuasa diiktiraf; (v) entiti berlesen itu telah dengan disedarinya dan dengan sengaja membekalkan maklumat yang palsu, mengelirukan atau tidak tepat atau tidak menzahirkan maklumat yang dikehendaki di bawah Akta ini; (vi) entiti berlesen itu menjalankan perniagaan mengikut cara yang Lembaga dengan munasabah mempercayai akan memudaratkan kepentingan, dalam hal entiti berlesen di bawah Bahagian III, pelabur dana bersama, atau kepentingan awam; (vii) entiti berlesen itu diisytiharkan bankrap atau telah digulungkan atau selainnya dibubarkan; (viii) suatu resolusi bagi penggulungan sukarela entiti berlesen itu telah diluluskan; (ix) berhubung dengan pemegang lesen bank atau pemegang lesen insurans, jika apa-apa jaminan atau aku janji yang disebut dalam seksyen 88 dan 89 atau seksyen 103 dan 104 telah tidak ditunaikan; atau (x) Lembaga mengikut budi bicaranya memikirkannya patut kerana apa-apa sebab lain.
