s 175 Accounts and records
(1) A licensed entity under this Act shall cause to be kept proper accounting and other records that will sufficiently explain the transaction and financial position of the licensed entity.
(2) Every licensed entity and the directors thereof shall cause appropriate entries to be made in the accounting and other records of the licensed entity within sixty days of completion of the transaction to which they relate.
(3) It shall be mandatory for the accounting and other records of a licensed entity to be kept at the registered office of the licensed entity or at such place in Labuan as the directors of the licensed entity think fit and the accounting and other records shall at all times be open to inspection by any director and shall be kept in such manner as to enable them to be conveniently and properly audited.
(4) The Authority may, in any particular case, direct that the accounting and other records of a licensed entity be open to
inspection by an auditor acting for a director, but only upon an undertaking in writing that the information acquired by the auditor during his inspection shall not be disclosed to him except to that director.
(5) Any director of a licensed entity who fails to take all reasonable steps to secure compliance by the licensed entity with the requirements of this section, or a director who has by his own wilful act been the cause of any default by the licensed entity under this section commits an offence.
(6) For the purposes of this section, βaccounting and other recordsβ shall include, if applicable, the following:
(a) all sums of money received and expended by the licensed entity and the matters in respect of which the receipt and expenditure took place;
(b) all sales and purchases of goods by the licensed entity;
(c) the assets and liabilities of the licensed entity; and
(d) all such relevant books and records as specified by the Authority.
(7) Notwithstanding subsection (3), the Authority may in writing allow a licensed entity to keep accounting and other records outside Labuan provided that the licensed entity shall also maintain accounts and records that reflect its financial position with reasonable accuracy and such accounts and records are updated once every six months in Labuan.

Akaun dan rekod
(1) Sesuatu entiti berlesen di bawah Akta ini hendaklah menyebabkan supaya disimpan rekod perakaunan dan rekod lain yang sepatutnya yang boleh menerangkan transaksi dan kedudukan kewangan entiti berlesen itu dengan secukupnya.
(2) Tiap-tiap entiti berlesen dan pengarahnya hendaklah menyebabkan catatan yang sewajarnya dibuat dalam rekod perakaunan dan rekod lain entiti berlesen itu dalam tempoh enam puluh hari selepas selesainya transaksi yang berhubungan dengannya.
(3) Menjadi wajib bagi rekod perakaunan dan rekod lain entiti berlesen disimpan di pejabat berdaftar entiti berlesen itu atau di mana-mana tempat di Labuan yang difikirkan patut oleh pengarah entiti berlesen itu dan rekod perakaunan dan rekod lain itu hendaklah pada setiap masa dibuka untuk pemeriksaan oleh mana-mana pengarah dan hendaklah disimpan mengikut apa-apa cara bagi membolehkan rekod-rekod itu diaudit dengan mudah dan sepatutnya.
(4) Lembaga boleh, dalam mana-mana hal tertentu, mengarahkan supaya rekod perakaunan dan rekod lain sesuatu entiti berlesen dibuka untuk pemeriksaan juruaudit yang bertindak bagi pihak seorang pengarah, tetapi hanya atas suatu aku janji secara bertulis bahawa maklumat yang diperoleh oleh juruaudit semasa pemeriksaannya itu tidak boleh didedahkan kepadanya kecuali kepada pengarah itu.
(5) Mana-mana pengarah sesuatu entiti berlesen yang tidak mengambil segala langkah munasabah untuk memastikan pematuhan kehendak seksyen ini oleh entiti berlesen itu, atau seorang pengarah yang dengan tindakan sengajanya telah menyebabkan keingkaran oleh entiti berlesen itu di bawah seksyen ini melakukan suatu kesalahan.
(6) Bagi maksud seksyen ini, βrekod perakaunan dan rekod lainβ hendaklah termasuk, jika berkenaan, yang berikut:
(a) semua jumlah wang yang diterima dan dibelanjakan oleh entiti berlesen dan perkara-perkara yang berkenaan dengannya penerimaan dan perbelanjaan itu telah dibuat;
(b) semua jualan dan belian barangan oleh entiti berlesen itu;
(c) aset dan liabiliti entiti berlesen itu; dan
(d) semua buku dan rekod yang berkaitan yang ditentukan oleh Lembaga.
(7) Walau apa pun subseksyen (3), Lembaga boleh secara bertulis membenarkan sesuatu entiti berlesen untuk menyimpan rekod perakaunan dan rekod lain di luar Labuan dengan syarat bahawa entiti berlesen itu hendaklah juga menyenggarakan akaun dan rekod yang menunjukkan kedudukan kewangannya dengan semunasabahnya tepat dan akaun dan rekod itu dikemaskinikan sekali dalam tiap-tiap enam bulan di Labuan.
