Labuan Financial Services and Securities Act 2010 s 35
(1) No registered public fund shall, in or outside Labuan, make an offer of securities unless prior to such offer it has lodged a prospectus with the Authority in accordance with the prospectus requirements under section 11. (2) For the avoidance of doubt, the civil and criminal liabilities for mis-statements in prospectuses provided for under Part II shall equally apply to a prospectus lodged under this section.
Prospektus yang berhubungan dengan dana awam
(1) Tiada dana awam berdaftar boleh, di dalam atau di luar Labuan, membuat suatu tawaran sekuriti melainkan jika sebelum tawaran itu dibuat, dana awam berdaftar itu telah menyerahkan suatu prospektus kepada Lembaga mengikut kehendak prospektus di bawah seksyen 11. (2) Bagi mengelak keraguan, liabiliti sivil dan jenayah bagi pernyataan silap dalam prospektus yang diperuntukkan di bawah Bahagian II hendaklah terpakai juga bagi prospektus yang diserahkan di bawah seksyen ini.
