s 44 Power to grant or refuse licence
(1) Upon receiving an application, the Authority may grant or refuse to grant a licence.
(2) The grant of a licence may be made subject to any terms, conditions, limitations or restrictions.
(3) Except with the written consent of the Authority no change shall be made in respect of the identity, residence, domicile, ownership or shareholding of the fund manager or fund administrator during the period of operation of the licence.
(4) The Authority shall not grantβ
(a) a licence to a fund manager of a public fund; or
(b) a licence to a fund administrator of a public fund,
unless it is satisfied that the applicant is a fit and proper person to engage in the business of fund management or fund administration of mutual funds.

Kuasa untuk memberikan atau enggan memberikan lesen
(1) Apabila diterima sesuatu permohonan, Lembaga boleh memberikan atau enggan memberikan lesen.
(2) Pemberian lesen boleh dibuat tertakluk kepada apa-apa terma, syarat, batasan atau sekatan.
(3) Kecuali dengan persetujuan bertulis Lembaga, tiada perubahan boleh dibuat berkenaan dengan identiti, tempat tinggal, domisil, pemunyaan atau pemegangan syer pengurus dana atau pentadbir dana dalam tempoh kuat kuasa lesen itu.
(4) Lembaga tidak boleh memberikanβ
(a) lesen kepada pengurus dana suatu dana awam; atau
(b) lesen kepada pentadbir dana suatu dana awam,
melainkan jika Lembaga berpuas hati bahawa pemohon itu ialah orang yang layak dan sesuai untuk terlibat dalam perniagaan pengurusan dana atau pentadbiran dana bagi dana bersama.
