(1) The Commission may bring proceedings before the High Court against any person who fails to comply with a direction given by the Commission under section 35 or a decision under section 40.
(2) If the High Court finds that the person referred to in subsection (1) fails to comply with the direction or decision, the High Court shall make an order requiring the person to comply with the direction or decision.
(3) For the purposes of subsection (2), where the High Court finds that the failure to comply with the decision includes a failure to pay a penalty within the specified period, the High Court shall, in addition to ordering that person to pay the penalty, order the person to pay interest at the normal judgment rate running from the day following that on which the payment was due.
(4) Any breach of an order of the High Court made pursuant to this section shall be punishable as a contempt of court.

Penguatkuasaan arahan atau keputusan
(1) Suruhanjaya boleh membawa prosiding di hadapan Mahkamah Tinggi terhadap mana-mana orang yang tidak mematuhi suatu arahan yang diberikan oleh Suruhanjaya di bawah seksyen 35 atau suatu keputusan di bawah seksyen 40.
(2) Jika Mahkamah Tinggi mendapati bahawa orang yang disebut dalam subseksyen (1) telah tidak mematuhi arahan atau keputusan itu, Mahkamah Tinggi hendaklah membuat suatu perintah menghendaki orang itu supaya mematuhi arahan atau keputusan itu.
(3) Bagi maksud subseksyen (2), jika Mahkamah Tinggi mendapati bahawa ketidakpatuhan arahan itu termasuklah suatu kegagalan untuk membayar penalti dalam tempoh yang dinyatakan, Mahkamah Tinggi hendaklah, sebagai tambahan kepada perintah supaya orang itu membayar penalti itu, memerintahkan supaya orang itu membayar bunga atas kadar penghakiman biasa mulai dari hari selepas bayaran itu kena dibuat.
(4) Mana-mana pelanggaran suatu perintah Mahkamah Tinggi yang dibuat menurut seksyen ini boleh dihukum sebagai suatu penghinaan mahkamah.
