s 48 Vacation of office and new or temporary appointment
(1) The office of the President or any other member of the Competition Appeal Tribunal shall be vacated if—
(a) he dies;
(b) he resigns or otherwise vacates his office before the expiry of the term for which he is appointed; or
(c) his appointment is revoked under section 47.
(2) The Prime Minister shall appoint another person in accordance with section 45 to replace the President or any other member of the Competition Appeal Tribunal during the vacancy in the office of the President or member of the Competition Appeal Tribunal.
(3) The Prime Minister may appoint temporarily another person in accordance with section 45 to act as the President or any other member of the Competition Appeal Tribunal—
(a) during any period when the President or a member is absent from duty or from Malaysia; or
(b) if the President or a member is, for any other reason, unable to perform the duties of his office temporarily.
(4) No act done or proceedings taken by the Competition Appeal Tribunal in exercise of its powers or the performance of its functions shall be affected on the ground of any vacancy in the membership of the Competition Appeal Tribunal.

Pengosongan jawatan dan pelantikan baharu atau sementara
(1) Jawatan Presiden atau mana-mana anggota lain Tribunal Rayuan Persaingan hendaklah menjadi kosong jika—
(a) dia mati;
(b) dia meletakkan jawatannya atau selainnya mengosongkan jawatannya sebelum habis tempoh yang baginya dia dilantik; atau
(c) pelantikannya dibatalkan di bawah seksyen 47.
(2) Perdana Menteri hendaklah melantik seseorang lain mengikut seksyen 45 untuk menggantikan Presiden atau mana-mana anggota lain Tribunal Rayuan Persaingan semasa kekosongan jawatan Presiden atau anggota Tribunal Rayuan Persaingan.
(3) Perdana Menteri boleh melantik seseorang lain secara sementara mengikut seksyen 45 untuk bertindak sebagai Presiden atau mana-mana anggota lain Tribunal Rayuan Persaingan—
(a) semasa apa-apa tempoh apabila Presiden atau anggota tidak hadir bertugas atau tidak ada di Malaysia; atau
(b) jika Presiden atau anggota, kerana apa-apa sebab lain, tidak berupaya untuk melaksanakan tugas jawatannya secara sementara.
(4) Tiada perbuatan yang dilakukan atau prosiding yang diambil oleh Tribunal Rayuan Persaingan dalam penjalanan kuasanya atau pelaksanaan fungsinya boleh terjejas atas alasan terdapat apa-apa kekosongan dalam keanggotaan Tribunal Rayuan Persaingan.
