s 101 Application for operator’s licence

(1) Subject to sections 194 and 195, no person shall operate any railway unless he holds an operator’s licence issued under this Chapter. (2) An application for an operator’s licence under this section shall be made to the Director General of Land Public Transport in the form and manner as determined by the Director General of Land Public Transport and shall be accompanied by the prescribed application fee and such information and documents as may be specified by the Director General of Land Public Transport. (3) The Director General of Land Public Transport shall, within such period as set out in the regulations made under paragraph 252(1)(tal), submit a written recommendation to the Minister on the application. (4) The written recommendation of the Director General of Land Public Transport shall specify— (a) the reasons for its recommendation; and (b) any conditions which the applicant should be subject to if the Director General of Land Public Transport recommends to the Minister to issue the operator’s licence. (5) The Minister may after having due regard to the recommendations of the Director General of Land Public Transport— (a) approve the application and issue an operator’s licence to the applicant upon payment of the prescribed fee; or (b) refuse the application. (6) Notwithstanding subsection (5), where a railway scheme has been approved in accordance with this Part, the railway company which submitted the railway scheme shall, subject to any condition or requirement imposed by the Minister on such approval, be deemed to be a qualified and suitable applicant for the purpose of operating the railway approved under the railway scheme, and the Minister shall, on an application by the railway company under subsection (2), approve the application and issue an operator’s licence to such railway company upon payment of the prescribed fee. (7) Every operator’s licence issued under this section shall set out the duration of the operator’s licence and the following conditions may be attached to the operator’s licence: (a) the type of railway system and railway services and related, peripheral or ancillary activities to be operated or provided by a licensed operator; (b) the annual licence fee payable by a licensed operator; (c) the fares which a licensed operator may impose on passengers; (d) the freight which a licensed operator may impose in respect of the carriage of goods; (e) the particular duties of a licensed operator in respect of the railway services operated or facilities provided by it; and (f) such other matters or conditions as the Minister thinks fit. (8) The Minister may, on the recommendation of the Director General of Land Public Transport, at any time, add, cancel or vary any of the conditions attached to an operator’s licence issued under this section. (9) The issuance of an operator’s licence to the applicant by the Minister under this section shall not impose any liability on the Director General of Land Public Transport or the Government for any loss or damage occasioned by any act, omission or default of the applicant. (10) A person who contravenes subsection (1) or any condition attached to an operator’s licence issued under this section commits an offence and shall, on conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both.

Permohonan bagi lesen pengendali

(1) Tertakluk kepada seksyen 194 dan 195, tiada seorang pun boleh mengendalikan mana-mana kereta api melainkan jika dia memegang suatu lesen pengendali yang dikeluarkan di bawah Bab ini. (2) Suatu permohonan bagi suatu lesen pengendali di bawah seksyen ini hendaklah dibuat kepada Suruhanjaya dalam bentuk dan mengikut cara yang ditentukan oleh Suruhanjaya dan hendaklah disertai dengan fi permohonan yang ditetapkan dan apa-apa maklumat dan dokumen yang dinyatakan oleh Suruhanjaya. (3) Suruhanjaya hendaklah, dalam apa-apa tempoh yang dinyatakan dalam kaedah-kaedah yang dibuat oleh Suruhanjaya di bawah perenggan 253(1)(nn), mengemukakan suatu syor bertulis kepada Menteri tentang permohonan itu. (4) Syor bertulis Suruhanjaya hendaklah menyatakan — (a) sebab-sebab bagi syornya; dan (b) apa-apa syarat yang pemohon sepatutnya dijadikan tertakluk kepadanya jika Suruhanjaya mengesyorkan kepada Menteri supaya mengeluarkan lesen pengendali itu. (5) Menteri boleh setelah mengambil kira dengan sewajarnya syor Suruhanjaya itu — (a) meluluskan permohonan itu dan mengeluarkan suatu lesen pengendali kepada pemohon apabila dibayar fi yang ditetapkan; atau (b) menolak permohonan itu. (6) Walau apa pun subseksyen (5), jika suatu skim kereta api telah diluluskan mengikut Bahagian ini, syarikat kereta api yang mengemukakan skim kereta api itu hendaklah, tertakluk kepada apa-apa syarat atau kehendak yang dikenakan oleh Menteri terhadap kelulusan itu, disifatkan sebagai seorang pemohon yang layak dan sesuai bagi maksud mengendalikan kereta api yang diluluskan di bawah skim kereta api itu, dan Menteri hendaklah, apabila permohonan dibuat oleh syarikat kereta api itu di bawah subseksyen (2), meluluskan permohonan itu dan mengeluarkan suatu lesen pengendali kepada syarikat kereta api itu apabila dibayar fi yang ditetapkan. (7) Tiap-tiap lesen pengendali yang dikeluarkan di bawah seksyen ini hendaklah menyatakan tempoh lesen pengendali itu dan syarat yang berikut boleh dikenakan pada lesen pengendali itu: (a) jenis sistem kereta api dan perkhidmatan kereta api dan aktiviti yang berhubungan, berdampingan atau bersampingan yang akan dikendalikan atau diadakan oleh seorang pengendali berlesen; (b) fi lesen tahunan yang kena dibayar oleh seorang pengendali berlesen; (c) tambang yang boleh dikenakan oleh seorang pengendali berlesen terhadap penumpang; (d) tambang muatan yang boleh dikenakan oleh seorang pengendali berlesen berkenaan dengan pembawaan barangan; (e) kewajipan tertentu seorang pengendali berlesen berkenaan dengan perkhidmatan kereta api yang dikendalikan atau kemudahan yang diadakan olehnya; dan (f) apa-apa perkara atau syarat lain yang difikirkan patut oleh Menteri. (8) Menteri boleh, atas syor Suruhanjaya, pada bila-bila masa, menambahkan, membatalkan atau mengubah mana-mana syarat yang dikenakan pada suatu lesen pengendali yang dikeluarkan di bawah seksyen ini. (9) Pengeluaran suatu lesen pengendali kepada pemohon oleh Menteri di bawah seksyen ini tidaklah mengenakan apa-apa tanggungan pada Suruhanjaya atau Kerajaan bagi apa-apa kerugian atau kerosakan yang disebabkan oleh apa-apa perbuatan, peninggalan atau kemungkiran pemohon itu. (10) Seseorang yang melanggar subseksyen (1) atau mana-mana syarat yang dikenakan pada suatu lesen pengendali yang dikeluarkan di bawah seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya.
