s 22 Pawnbroker’s responsibility with regard to pledge

(1) Every pawnbroker shall exercise the same care and diligence in the custody of pledge as a prudent owner would exercise in the custody of his own property. (2) The pawnbroker shall be responsible for the loss or damage of any pledge, whether such loss or damage be caused by or in consequence of fire, negligence, omission, theft, robbery or otherwise. (3) In the case of any pledge destroyed or damaged by or in consequence of fire, negligence, omission, theft, robbery or otherwise, the value of the pledge shall for the purposes of the compensation of the pawner, be assumed to be one quarter more than the amount of the loan. (4) Upon complaint by any person that any pledge held by a pawnbroker, which the person is entitled to redeem, has not been delivered to him on due demand or has become or been rendered of less value than it was at the time of pawning by or through the default, neglect or misbehaviour of the pawnbroker, a Magistrate may, if he so thinks fit, order reasonable compensation to be paid by the pawnbroker to the person; and any sum so ordered to be paid may, if the Magistrate so directs, be recoverable from the pawnbroker as a fine.

Tanggungjawab pemegang pajak gadai berkenaan dengan sandaran

(1) Tiap-tiap pemegang pajak gadai hendaklah menjaga sandaran itu dengan cermat dan bersungguh-sungguh sebagaimana seseorang pemunya yang berhemat menjaga hartanya sendiri. (2) Pemegang pajak gadai hendaklah bertanggungjawab bagi kehilangan atau kerosakan apa-apa sandaran, sama ada kehilangan atau kerosakan sedemikian disebabkan oleh atau akibat daripada kebakaran, kecuaian, peninggalan, kecurian, rompakan atau selainnya. (3) Dalam hal mana-mana sandaran yang telah binasa atau rosak kerana atau akibat kebakaran, kecuaian, peninggalan, kecurian, rompakan atau selainnya, nilai sandaran itu hendaklah bagi maksud pampasan kepada pemajak gadai itu dikira sebagai satu perempat lebih daripada jumlah pinjaman atasnya. (4) Apabila mana-mana orang mengadu bahawa mana-mana sandaran yang dipegang oleh seseorang pemegang pajak gadai, yang dia berhak menebus, telah tidak diserahkan kepadanya apabila diminta dengan sewajar olehnya atau telah menjadi atau dijadikan kurang bernilai berbanding pada masa pemajakgadaian oleh kerana atau disebabkan keingkaran, keabaian atau salah laku pemegang pajak gadai itu, seseorang Majistret boleh, jika difikirkannya patut, memerintahkan supaya pampasan yang munasabah dibayar oleh pemegang pajak gadai kepada orang itu; dan apa-apa wang yang diperintahkan sedemikian supaya dibayar boleh, jika diarahkan sedemikian oleh Majistret, didapatkan balik daripada pemegang pajak gadai itu sebagai suatu denda.
