s 3 Definition of “trademark”
(1) “Trademark” means any sign capable of being represented graphically which is capable of distinguishing goods or services of one undertaking from those of other undertakings.
(2) A sign may constitute a trademark even though it is used in relation to a service ancillary to the trade or business of an undertaking and whether or not the service is provided for money or money’s worth.
(3) References in this Act to a trademark includes, unless the context otherwise requires, references to a collective mark or certification mark.

Takrif “cap dagangan”
(1) “Cap dagangan” ertinya apa-apa tanda yang boleh dinyatakan secara grafik yang boleh membezakan barang-barang atau perkhidmatan satu perusahaan daripada perusahaan-perusahaan yang lain.
(2) Suatu tanda boleh menjadi suatu cap dagangan walaupun tanda itu digunakan berhubung dengan perkhidmatan sampingan kepada suatu perdagangan atau perniagaan perusahaan dan sama ada atau tidak perkhidmatan itu disediakan untuk wang atau nilaian wang.
(3) Sebutan mengenai cap dagangan dalam Akta ini, melainkan jika konteksnya menghendaki makna yang lain, termasuklah sebutan mengenai cap kolektif atau cap perakuan.
