s 30 Voluntary disclaimer, condition or limitation

(1) An applicant for the registration of a trademark may apply in the form as determined by the Registrar— (a) to disclaim any right to the exclusive use of any specified element of the trademark; or (b) to agree that the rights arising out of the registration shall be subject to certain conditions or limitations imposed by the Registrar. (2) The Registrar may refuse any application under paragraph (1)(a) if the application contains or consists of any matters which is not allowed under the absolute and relative grounds for refusal of registration under sections 23 and 24. (3) A disclaimer made by the applicant, or condition or limitation imposed by the Registrar, under subsection (1), shall not be revoked if the application has been accepted by the Registrar.

Penafian sukarela, syarat atau pengehadan

(1) Seseorang pemohon bagi pendaftaran suatu cap dagangan boleh memohon mengikut bentuk yang ditentukan oleh Pendaftar— (a) untuk menafikan apa-apa hak bagi penggunaan eksklusif bagi mana-mana elemen yang dinyatakan dalam cap dagangan itu; atau (b) untuk bersetuju bahawa hak yang timbul daripada pendaftaran itu adalah tertakluk kepada syarat atau pengehadan tertentu yang dikenakan oleh Pendaftar. (2) Pendaftar boleh menolak apa-apa permohonan di bawah perenggan (1)(a) jika permohonan itu mengandungi atau terdiri daripada apa-apa perkara yang tidak dibenarkan di bawah alasan mutlak dan relatif bagi penolakan pendaftaran di bawah seksyen 23 dan 24. (3) Penafian yang dibuat oleh pemohon, atau syarat atau pengehadan yang dikenakan oleh Pendaftar, di bawah subseksyen (1), tidak boleh dibatalkan jika permohonan itu telah disetuju terima oleh Pendaftar.
