s 40 Status of unrenewed trademark
(1) In a case of unrenewed trademark where—
(a) the registration of trademark is not renewed; or
(b) the registration of trademark has been deemed removed and has not been restored,
a person other than the person who was registered as the proprietor of the unrenewed trademark may apply for the registration of trademark.
(2) Where an application for the registration of an unrenewed trademark is made by a person other than the person who was registered as the proprietor of the unrenewed trademark, the unrenewed trademark is taken to be a registered trademark for the purposes of an examination in subsection 29(2) of the application at any time when the registration of the unrenewed trademark could have been renewed and restored under section 39.

Status cap dagangan yang tidak dibaharui
(1) Dalam hal keadaan cap dagangan tidak dibaharui yang—
(a) pendaftaran cap dagangan itu tidak dibaharui; atau
(b) pendaftaran cap dagangan disifatkan dikeluarkan dan tidak dimasukkan semula,
seseorang selain orang yang berdaftar sebagai tuan punya cap dagangan yang tidak dibaharui itu boleh memohon bagi pendaftaran cap dagangan.
(2) Jika suatu permohonan bagi pendaftaran suatu cap dagangan yang tidak dibaharui dibuat oleh seseorang selain orang yang telah didaftarkan sebagai tuan punya cap dagangan yang tidak dibaharui itu, cap dagangan yang tidak dibaharui itu dikira sebagai cap dagangan berdaftar bagi maksud suatu pemeriksaan di bawah subseksyen 29(2) bagi permohonan itu pada bila-bila masa yang pendaftaran cap dagangan yang tidak dibaharui itu sepatutnya boleh dibaharui dan dimasukkan semula di bawah seksyen 39.
