s 46 Revocation of registration by Court as to non-use of trademark

(1) The registration of a trademark may be revoked by the Court on an application by an aggrieved person on any of the grounds as follows: (a) where within a period of three years following the date of issuance of the notification of registration, the trademark has not been put to use in good faith in Malaysia, by the registered proprietor or with his consent, in relation to the goods or services for which the trademark is registered, and there are no proper reasons for non-use; (b) where the use of the goods or services under paragraph (a) has been suspended for an uninterrupted period of three years, and there are no proper reasons for non-use; (c) where in consequence of acts or inactivity of the registered proprietor, it has become the common name in the trade for the product or service for which it is registered; or (d) where in consequence of the use of the trademark by the registered proprietor or with his consent in relation to the goods or services for which the trademark is registered, it is liable to mislead the public, including in respect of the nature, quality or geographical origin of those goods or services. (2) Subject to subsection (3), the registration of trademark shall not be revoked on the ground under paragraph (1)(a) or (b) if such use as is referred to in that paragraph is begun or resumed after the expiry of the three year period and before the application for revocation is made. (3) Any such use referred to in paragraph (1)(a) or (b) that has begun or resumed after the expiry of the three year period but within the period of three months before the making of the application for revocation shall be disregarded unless preparations of such use began before the proprietor became aware that the application for revocation might be made. (4) Where grounds for revocation exist in respect of only some of the goods or services for which the trademark is registered, revocation shall relate to those goods or services only. (5) Where the registration of trademark is revoked to any extent, the rights of the registered proprietor shall be deemed to have ceased to that extent as from— (a) the date of the application for revocation; or (b) if the Court is satisfied that the grounds for revocation exists at an earlier date, that date.

Pembatalan pendaftaran oleh Mahkamah atas ketiadaan penggunaan cap dagangan

(1) Pendaftaran cap dagangan boleh dibatalkan oleh Mahkamah atas suatu permohonan oleh seseorang yang terkilan atas apa-apa alasan yang berikut: (a) jika dalam tempoh tiga tahun berikutan tarikh pengeluaran pemberitahuan pendaftaran, cap dagangan itu tidak digunakan dengan suci hati di Malaysia, oleh tuan punya berdaftar atau dengan persetujuannya, berhubung dengan barang-barang atau perkhidmatan yang baginya cap dagangan itu didaftarkan, dan tiada sebab yang wajar untuk tidak menggunakannya; (b) jika penggunaan barang-barang atau perkhidmatan di bawah perenggan (a) telah digantung bagi tempoh tiga tahun berturut-turut, dan tiada sebab yang wajar untuk tidak menggunakannya; (c) jika berbangkit daripada perbuatan atau pembiaran tuan punya berdaftar, ia telah menjadi nama lazim dalam perdagangan bagi produk atau perkhidmatan yang baginya ia didaftarkan; atau (d) jika berbangkit daripada penggunaan cap dagangan itu oleh tuan punya berdaftar atau dengan persetujuannya berhubung dengan barang-barang atau perkhidmatan yang baginya cap dagangan itu didaftarkan, ia boleh mengelirukan orang awam, termasuk berkenaan dengan sifat, kualiti atau tempat asal geografi barang-barang atau perkhidmatan itu. (2) Tertakluk kepada subseksyen (3), pendaftaran cap dagangan tidak boleh dibatalkan atas alasan di bawah perenggan (1)(a) atau (b) jika penggunaan itu sebagaimana yang disebut dalam perenggan itu dimulakan atau disambung semula selepas habis tempoh tiga tahun dan sebelum permohonan pembatalan itu dibuat. (3) Apa-apa penggunaan yang disebut dalam perenggan (1)(a) atau (b) yang telah dimulakan atau disambung semula selepas habis tempoh tiga tahun tetapi dalam tempoh tiga bulan sebelum permohonan dibuat bagi pembatalan tidak boleh diambil kira melainkan jika persediaan bagi penggunaan itu bermula sebelum tuan punya menyedari bahawa permohonan bagi pembatalan boleh dibuat. (4) Jika alasan bagi pembatalan wujud berkenaan dengan hanya beberapa barang-barang atau perkhidmatan yang baginya cap dagangan itu didaftarkan, pembatalan hendaklah berkaitan dengan barang-barang atau perkhidmatan itu sahaja. (5) Jika pendaftaran cap dagangan itu dibatalkan sehingga apa-apa takat, hak tuan punya berdaftar itu hendaklah disifatkan telah terhenti pada takat itu dari— (a) tarikh permohonan bagi pembatalan; atau (b) jika Mahkamah berpuas hati bahawa alasan bagi pembatalan wujud pada tarikh yang lebih awal, tarikh itu.
