s 53 Registration conclusive
In all legal proceedings relating to a trademark in the Register, the original registration of the trademark shall, after the expiration of five years from the date of registration be taken to be valid in all respects unless it is shown that—
(a) the original registration was obtained by fraud;
(b) the trademark offends paragraph 23(5)(a), (c), (d) or (e); or
(c) the trademark was, at the commencement of the proceedings, devoid of distinctiveness of the goods or services of the registered proprietor.

Pendaftaran muktamad
Dalam semua prosiding undang-undang yang berhubungan dengan suatu cap dagangan dalam Daftar, pendaftaran asal cap dagangan itu hendaklah, selepas habis tempoh lima tahun dari
tarikh pendaftaran itu dikira sebagai sah mengenai semua perkara melainkan jika dibuktikan bahawa—
(a) pendaftaran asal itu telah diperoleh secara fraud;
(b) cap dagangan itu bersalahan dengan perenggan 23(5)(a),
(c), (d) atau (e); atau
(c) cap dagangan itu, pada permulaan prosiding, lagi tidak distingtif bagi barang-barang atau perkhidmatan tuan punya berdaftar itu.
