Trademarks Act 2019 s 83
The Registrar shall, upon giving his approval under section 82, require the applicant to deposit with the Registrar a security which in the opinion of the Registrar is sufficient toβ (a) reimburse the Registrar for any liability or expense it is likely to incur as a result of the seizure of the infringing goods; (b) prevent abuse and to protect the importer; or (c) pay such compensation as may be ordered by the Court under this Part.
Cagaran
Pendaftar hendaklah, selepas memberikan kelulusannya di bawah seksyen 82, menghendaki pemohon untuk mendepositkan dengan Pendaftar suatu cagaran yang pada pendapat Pendaftar mencukupi untukβ (a) membayar ganti kepada Pendaftar bagi apa-apa liabiliti atau perbelanjaan yang mungkin ditanggung disebabkan penyitaan barang-barang yang melanggar itu; (b) menghalang penyalahgunaan dan melindungi pengimport; atau (c) membayar apa-apa pampasan sebagaimana yang diperintahkan oleh Mahkamah di bawah Bahagian ini.
