s 85 Notice

(1) As soon as is reasonably practicable after the infringing goods are seized under section 82, the authorized officer shall give to the Registrar, importer and the applicant, either personally or by registered post, a written notice identifying the infringing goods, stating that they have been seized and the whereabout of the goods. (2) A notice under subsection (1) shall also state that the infringing goods will be released to the importer unless an action for infringement in respect of the goods is instituted by the applicant within a specified period from the date of the notice. (3) If at the time of the receipt of the notice an action for infringement has been instituted by the applicant, the applicant shall notify the Registrar of that fact in the form as determined by the Registrar. (4) The applicant may, by written notice given to the Registrar before the end of the period specified in the notice (the initial period), request that the period be extended. (5) Subject to subsection (6), the Registrar may extend the initial period upon a request made in accordance with subsection (4) where the Registrar is satisfied that it is reasonable that the request be granted. (6) A decision on a request made in accordance with subsection (4) shall be made within two working days after the request is made, but such decision cannot be made after the end of the initial period to which the request relates.

(1) Dengan seberapa segera yang semunasabahnya dapat dilaksanakan selepas barang-barang yang melanggar itu disita di bawah seksyen 82, pegawai diberi kuasa itu hendaklah memberi kepada Pendaftar, pengimport dan pemohon, sama ada dengan sendiri atau melalui pos berdaftar, suatu notis bertulis yang mengenal pasti barang-barang yang melanggar itu, yang menyatakan bahawa barang-barang itu telah disita dan tempat barang-barang itu berada. (2) Suatu notis di bawah subseksyen (1) hendaklah juga menyatakan bahawa barang-barang yang melanggar itu akan dilepaskan kepada pengimport melainkan jika suatu tindakan bagi pelanggaran berkenaan dengan barang-barang itu dimulakan oleh pemohon dalam tempoh yang dinyatakan dari tarikh notis itu. (3) Jika pada masa notis itu diterima suatu tindakan bagi pelanggaran telah dimulakan oleh pemohon, pemohon itu hendaklah memberitahu Pendaftar akan hakikat itu mengikut bentuk sebagaimana yang ditentukan oleh Pendaftar. (4) Pemohon boleh, melalui notis bertulis yang diberikan kepada Pendaftar sebelum tamat tempoh yang dinyatakan dalam notis (tempoh permulaan itu), meminta supaya tempoh itu dilanjutkan. (5) Tertakluk kepada subseksyen (6), Pendaftar boleh melanjutkan tempoh permulaan apabila suatu permintaan dibuat mengikut subseksyen (4) jika Pendaftar berpuas hati bahawa adalah munasabah untuk membenarkan permintaan itu. (6) Suatu keputusan mengenai permintaan yang dibuat mengikut subseksyen (4) hendaklah dibuat dalam masa dua hari bekerja selepas permintaan itu dibuat, tetapi keputusan itu tidak boleh dibuat selepas tamatnya tempoh permulaan yang dengannya permintaan itu berkaitan.
