s 86 Inspection, release, etc., of seized goods

(1) The Registrar may permit the applicant or importer to inspect the seized goods if the applicant or importer agrees to give the requisite undertakings. (2) The requisite undertakings under subsection (1) are undertakings in writing that the person giving the undertakings shall— (a) return the sample of the seized goods to the Registrar at a specified time that is satisfactory to the Registrar; and (b) take reasonable care to prevent damage to the sample. (3) If the applicant gives the requisite undertakings, the Registrar may permit the applicant to remove a sample of the seized goods from the custody of the Registrar for inspection by the applicant. (4) If the importer gives the requisite undertakings, the Registrar may permit the importer to remove a sample of the seized goods from the custody of the Registrar for inspection by the importer. (5) If the Registrar permits inspection of the seized goods, or the removal of a sample of the seized goods, by the applicant in accordance with this section, the Registrar shall not be liable to the importer for any loss or damage suffered by the importer arising out of— (a) damage to any of the seized goods incurred during that inspection; or (b) anything done by the applicant or any other person to, or in relation to, a sample removed from the custody of the Registrar or any use made by the applicant or any other person of such a sample.

Pemeriksaan, pelepasan dsb., barang-barang yang disita

(1) Pendaftar boleh membenarkan pemohon atau pengimport untuk memeriksa barang-barang yang disita jika pemohon atau pengimport bersetuju untuk memberikan aku janji yang diperlukan. (2) Aku janji yang diperlukan di bawah subseksyen (1) ialah aku janji secara bertulis bahawa orang yang memberi aku janji itu hendaklah— (a) memulangkan sampel barang-barang yang disita itu kepada Pendaftar pada masa yang dinyatakan yang memuaskan hati Pendaftar; dan (b) mengambil penjagaan yang munasabah untuk mencegah kerosakan kepada sampel itu. (3) Jika pemohon memberikan aku janji yang diperlukan, Pendaftar boleh membenarkan pemohon mengambil sampel barang-barang yang disita itu daripada jagaan Pendaftar bagi pemeriksaan oleh pemohon. (4) Jika pengimport memberikan aku janji yang diperlukan, Pendaftar boleh membenarkan pengimport untuk mengambil sampel barang-barang yang disita itu daripada jagaan Pendaftar bagi pemeriksaan oleh pengimport. (5) Jika Pendaftar membenarkan pemeriksaan barang-barang yang disita itu, atau pengambilan sampel barang-barang yang disita itu, oleh pemohon mengikut seksyen ini, Pendaftar tidaklah bertanggungan kepada pengimport bagi apa-apa kerugian atau kerosakan yang ditanggung oleh pengimport berbangkit daripada— (a) kerosakan kepada mana-mana barang-barang yang disita yang berlaku semasa pemeriksaan itu; atau (b) apa-apa jua yang dilakukan oleh pemohon atau mana-mana orang lain kepada, atau berhubung dengan, sampel yang diambil daripada jagaan Pendaftar atau apa-apa penggunaan sampel itu yang dibuat oleh pemohon atau mana-mana orang lain.
