s 99 Counterfeiting a trademark

(1) Any person who counterfeits a registered trademark by— (a) making a sign identical with or similar to a registered trademark with the intent to deceive; or (b) falsifying a genuine registered trademark, whether by alteration, addition, effacement, partial removal or otherwise, without the consent of the registered proprietor of the trademark commits an offence and shall, on conviction, be liable to a fine not exceeding one million ringgit or to imprisonment for a term not exceeding five years or to both. (2) In a prosecution under this section, the burden of proving the consent of the registered proprietor of the trademark shall be upon the accused person.

Pemelancungan cap dagangan

(1) Mana-mana orang yang melancungkan suatu cap dagangan berdaftar dengan— (a) membuat suatu tanda yang serupa atau hampir serupa dengan cap dagangan berdaftar dengan niat untuk menipu; atau (b) memalsukan suatu cap dagangan berdaftar tulen, sama ada dengan pengubahan, penambahan, pemadaman, penghapusan separa atau sebaliknya, tanpa persetujuan tuan punya berdaftar cap dagangan itu melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu juta ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya. (2) Dalam suatu pendakwaan di bawah seksyen ini, beban untuk membuktikan persetujuan tuan punya berdaftar cap dagangan itu hendaklah terletak pada tertuduh.
