s 53 Access to recorded information or computerized data, etc.

(1) Any Assistant Controller exercising his powers under section 50, 51 or 52 shall be given access to any recorded information, or computerized or digitalized data, whether stored in a computer or otherwise. (2) In addition to his powers under subsection (1), the Assistant Controller may— (a) inspect the operation of any computer and any associated apparatus or material which he has reasonable cause to suspect is or has been used in connection with that information or data; and (b) require— (i) the person, by whom or on whose behalf the Assistant Controller has reasonable cause to suspect the computer is or has been so used in connection with the information or data; or (ii) the person having charge of, or is otherwise concerned with, the operation of the computer, apparatus or material in connection with the information or data, to provide him with such reasonable assistance as he may require for the purposes of this section. (3) The Assistant Controller may make copies or take extracts of the recorded information, or the computerized or digitalized data, if he thinks necessary. (4) For the purposes of this section, “access” includes being provided with the necessary password, encryption code, decryption code, software or hardware and any other means required to enable comprehension of recorded information and computerized or digitalized data.

Akses kepada maklumat berekod atau data berkomputer, dsb.

(1) Mana-mana Penolong Pengawal yang menjalankan kuasanya di bawah seksyen 50, 51 atau 52 hendaklah diberikan akses kepada apa-apa maklumat berekod, atau data berkomputer atau berdigital, sama ada yang disimpan dalam suatu komputer atau selainnya. (2) Sebagai tambahan kepada kuasanya di bawah subseksyen (1), Penolong Pengawal itu boleh— (a) memeriksa pengendalian apa-apa komputer dan apa-apa radas atau bahan yang berkaitan yang dia mempunyai sebab yang munasabah untuk mengesyaki sedang atau telah digunakan berkaitan dengan maklumat atau data itu; dan (b) menghendaki— (i) orang yang, olehnya atau bagi pihaknya Penolong Pengawal itu mempunyai sebab yang munasabah untuk mengesyaki komputer itu sedang atau telah digunakan berkaitan dengan maklumat atau data itu; atau (ii) orang yang bertanggungjawab bagi, atau yang selainnya terlibat dengan, pengendalian komputer, radas atau bahan itu berkaitan dengan maklumat atau data, untuk memberinya apa-apa bantuan yang munasabah sebagaimana yang dikehendaki olehnya bagi maksud seksyen ini. (3) Penolong Pengawal boleh membuat salinan atau mengambil cabutan maklumat berekod itu, atau data berkomputer atau berdigital itu, jika difikirkannya perlu. (4) Bagi maksud seksyen ini, “akses” termasuklah diberikan kata laluan, kod penyulitan, kod penyahsulitan, perisian atau perkakasan yang perlu dan apa-apa cara lain yang dikehendaki untuk membolehkan pemahaman maklumat berekod dan data berkomputer atau berdigital itu.
