s 79 Exception for certain uses of geographical indication
(1) Section 77 shall not apply to the use of a geographical indication—
(a) which is contrary to public order or morality in Malaysia;
(b) which is not or has ceased to be protected in its country or territory of origin;
(c) in relation to any goods or services which is identical with the term customary in the common language as the common name of the goods or services in Malaysia;
(d) which is identical with the customary name of a grape variety existing in Malaysia as of 1 January 1995, with respect to products of the vine of that grape variety; or
(e) which is not registered under this Act, and which has fallen into disuse in its country or territory of origin.

Kecualian bagi penggunaan tertentu petunjuk geografi
(1) Seksyen 77 tidak terpakai bagi penggunaan suatu petunjuk geografi—
(a) yang bertentangan dengan ketenteraman awam atau kemoralan di Malaysia;
(b) yang tidak atau telah terhenti daripada dilindungi di negara atau wilayah asalnya;
(c) berhubung dengan apa-apa barang atau perkhidmatan yang sama dengan terma yang lazim dalam bahasa umum sebagai nama umum bagi barang atau perkhidmatan itu di Malaysia;
(d) yang sama dengan nama lazim bagi suatu jenis anggur yang wujud di Malaysia mulai 1 Januari 1995, yang berkenaan dengan hasil pokok anggur daripada jenis anggur itu; atau
(e) yang tidak berdaftar di bawah Akta ini, dan yang tidak lagi digunakan di negara atau wilayah asalnya.
