AMENDING PRESIDENTIAL DECREE NO. 1271 ENTITLED "AN ACT NULLIFYING DECREES OF REGISTRATION AND CERTIFICATES OF TITLE COVERING LANDS WITHIN THE BAGUIO TOWNSITE RESERVATION ISSUED IN CIVIL RESERVATION CASE NO. 1, GLRO RECORD NO. 211 PURSUANT TO REPUBLIC ACT NO. 931, AS AMENDED, BUT CONSIDERING AS VALID CERTAIN TITLES OF SUCH LANDS THAT ARE ALIENABLE AND DISPOSABLE UNDER CERTAIN CONDITIONS AND FOR OTHER PURPOSES."

Preamble

WHEREAS, the period fixed under PD No. 1271 within which

manifestations of intention to validate titles to lands within the Baguio

Townsite Reservation shall be filed shall expire on March 22, 1978;

WHEREAS, most landowners affected are still unaware of the

provisions of said Decree for reasons not attributable to them;

WHEREAS, prospective applicants find it difficult to comply

with the requirements imposed by the Decree for validation of titles

thereunder.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the

Philippines, by virtue of the powers vested in by the constitution, do hereby

order and decree the following:

Section 1

SECTION 1. Section 1, paragraph b, of Presidential Decree

No. 1271 is hereby amended to read as follows:

"b. Payment by the present title-holder to the Republic of the Philippines of

an amount equivalent to fifteen per centum (15%) of the assessed value of the

land whose title is voided as of revision period 1973 (P.D. 76), the amount

payable as follows: within one (1) year from the effectivity of this Decree, the

holders of the titles affected shall manifest their desire to avail of the

benefits of this provision and shall pay ten per centum (10%) of the above

amount and the balance in two equal installments, the first installment to be

paid within the second year of the effectivity of this Decree and the second

installment within a year thereafter."

Section 2

SECTION 2. A new paragraph is hereby added to section 1

which shall be denominated paragraph c :

"c. Submission by the applicant, together with his application, of the

following documents:

The owner's copy of the title or documents of transfer of ownership, or

certified xerox copy thereof;

Certified xerox copy of 1973 Tax Declaration; and

Certified xerox copy of the official receipt showing payment of 10% of 15%

of the assessed value of the land."

Section 3

SECTION 3. Section 3 is also hereby amended by changing the

phrase "within ninety (90) days from the effectivity of this Decree" to "within

one (1) year from the effectivity of this Decree.

Section 4

SECTION 4. Section 4 is likewise hereby amended by changing

the phrase "Ninety (90) days after the effectivity of this Decree" to the phrase

"One year after the effectivity of this Decree."

Section 5

SECTION 5. All laws, decrees, orders, letters of

instructions, rules and regulations, or parts thereof, contrary to or

inconsistent with the provisions of this Decree are hereby repealed or modified

accordingly.

Section 6

SECTION 6. This Decree shall take effect immediately.

DONE in the City of Manila, this 10th day of March, in the year of Our Lord,

nineteen hundred and seventy-eight.
